1 AMENDMENT TO HOUSE BILL 721
2 AMENDMENT NO. . Amend House Bill 721 as follows:
3 by replacing the title with the following:
4 "AN ACT to amend the Health Care Surrogate Act by adding
5 Section 60."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Health Care Surrogate Act is amended by
9 adding Section 60 as follows:
10 (755 ILCS 40/60 new)
11 Sec. 60. Health care surrogate; specific mental health
12 services.
13 (a) In this Section, "specific mental health services"
14 means the administration of authorized involuntary treatment
15 as defined in Section 1-121.5 of the Mental Health and
16 Developmental Disabilities Code or admission to a mental
17 health facility as defined in Section 1-114 of that Code.
18 (b) A surrogate decision maker, other than a court
19 appointed guardian, may not consent to specific mental health
20 services for an adult patient. A surrogate decision maker

1 may, however, petition for the provision of specific mental
2 health services pursuant to the Mental Health and
3 Developmental Disabilities Code.
4 Section 99. Effective date. This Act takes effect
5 January 1, 2000.".
