1 AN ACT to amend the Public Utilities Act by changing
2 Section 4-203.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 4-203 as follows:
7 (220 ILCS 5/4-203) (from Ch. 111 2/3, par. 4-203)
8 Sec. 4-203. Action to recover penalties. Except as
9 otherwise provided in this Act, actions to recover penalties
10 under this Act shall be brought in the name of the People of
11 the State of Illinois in the circuit court in and for the
12 county in which the cause, or some part thereof, arose, or in
13 which the corporation complained of, if any, has its
14 principal place of business, or in which the person, if any,
15 complained of, resides. The action shall be commenced and
16 prosecuted to final judgment by the Commission. In any such
17 action, all penalties incurred up to the time of commencing
18 the same may be sued for and recovered. In all such actions,
19 the procedure and rules of evidence shall be the same as in
20 ordinary civil actions, except as otherwise herein provided.
21 All fines and penalties recovered by the State in any such
22 action shall be paid into the State treasury to the credit of
23 the general fund. Any such action may be compromised or
24 discontinued on application of the Commission upon such terms
25 as the court shall approve and order.
