 1        AN ACT to amend the School Code by changing Sections 30-9
 2    and 30-13.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The  School  Code  is  amended  by changing
 6    Sections 30-9 and 30-13 as follows:

 7        (105 ILCS 5/30-9) (from Ch. 122, par. 30-9)
 8        Sec. 30-9. General Assembly  scholarship;  conditions  of
 9    admission;  award by competitive examination.  Each member of
10    the General Assembly  may  nominate  annually  2  persons  of
11    school  age  and  otherwise  eligible, from his district; one
12    shall  receive,  subject  to  appropriation  by  the  General
13    Assembly,  a certificate of scholarship in the University  of
14    Illinois   and   the   other   shall   receive,   subject  to
15    appropriation by  the  General  Assembly,  a  certificate  of
16    scholarship   in   any   other   State  supported  university
17    designated by the member. Any member of the General  Assembly
18    in  making  nominations under this Section may designate that
19    his nominee be granted a 4 year scholarship  or  may  instead
20    designate  2  or  4 nominees for that particular scholarship,
21    each to receive, subject  to  appropriation  by  the  General
22    Assembly,  a  2 year or a one year scholarship, respectively.
23    The nominee, if a graduate of  a  school  accredited  by  the
24    University  to  which  nominated,  shall  be  admitted to the
25    university  on  the  same  conditions   as   to   educational
26    qualifications  as are other graduates of accredited schools.
27    If the nominee is not a graduate of a  school  accredited  by
28    the  university  to  which  nominated,  he must, before being
29    entitled  to  the  benefits  of  the  scholarship,  pass   an
30    examination  given  by  the  superintendent of schools of the
31    county where he resides at the time stated  in  Section  30-7

 1    for  the  competitive  examination.  The  president  of  each
 2    university   shall   prescribe   the   rules   governing  the
 3    examination for scholarship to his university.
 4        A  member  of  the  General  Assembly   may   award   the
 5    scholarship  by  competitive examination conducted under like
 6    rules as prescribed in Section 30-7 even though one  or  more
 7    of  the applicants are graduates of schools accredited by the
 8    university.
 9        A member of the General  Assembly  may  delegate  to  the
10    Illinois  Student  Assistance  Commission  the  authority  to
11    nominate persons for General Assembly scholarships which that
12    member  would  otherwise  be entitled to award, or may direct
13    the Commission to evaluate and make  recommendations  to  the
14    member  concerning  candidates  for such scholarships. In the
15    event a member delegates his nominating authority or  directs
16    the   Commission   to   evaluate   and  make  recommendations
17    concerning candidates for General Assembly scholarships,  the
18    member shall inform the Commission in writing of the criteria
19    which  he  wishes  the  Commission  to apply in nominating or
20    recommending candidates. Those criteria may include  some  or
21    all  of  the  criteria  provided  in Section 25 of the Higher
22    Education Student Assistance Act. A delegation  of  authority
23    under  this  paragraph  may  be  revoked  at  any time by the
24    member.
25        Failure of a member of the General  Assembly  to  make  a
26    nomination  in  any  year shall not cause that scholarship to
27    lapse,  but  the  member  may  make  a  nomination  for  such
28    scholarship at any time thereafter before the  expiration  of
29    his  term,  and  the person so nominated shall be entitled to
30    the same benefits as holders of other  scholarships  provided
31    herein.  Any  such scholarship for which a member has made no
32    nomination prior to the expiration of the term for  which  he
33    was elected shall lapse upon the expiration of that term.
34        The  funds  used  to  award General Assembly scholarships

 1    shall be appropriated  to  the  Illinois  Student  Assistance
 2    Commission.  The Illinois Student Assistance Commission shall
 3    distribute   the   scholarship   funds   to  the  appropriate
 4    universities.  If  the  appropriation  for  General  Assembly
 5    scholarships  is  insufficient  to  fund  all  of  the year's
 6    scholarships, the appropriation available shall  be  prorated
 7    by  the  Illinois  Student Assistance Commission among all of
 8    the nominees.  The  Illinois  Student  Assistance  Commission
 9    shall   notify  the  General  Assembly  and  the  appropriate
10    universities of the shortfall.  If the General Assembly  does
11    not   appropriate  additional  moneys  to  make  up  for  the
12    shortfall, the universities shall charge the nominees for the
13    amount of the shortfall.

16        Sec. 30-13.  The scholarships issued under Sections  30-9
17    through  30-12  of this Article may be used at the University
18    of Illinois,  Southern  Illinois  University,  Chicago  State
19    University,  Eastern  Illinois  University,  Governors  State
20    University,  Illinois State University, Northeastern Illinois
21    University,  Northern  Illinois   University,   and   Western
22    Illinois  University  as  provided  in those Sections. Unless
23    otherwise indicated, these scholarships shall be good  for  a
24    period  of not more than 4 years while enrolled for residence
25    credit and shall  exempt  the  holder  from  the  payment  of
26    tuition,  or any matriculation, graduation, activity, term or
27    incidental fee, except any  portion  of  a  multipurpose  fee
28    which  is  used  for  a  purpose  for  which exemption is not
29    granted under this Section.  Exemption shall not  be  granted
30    from   any   other  fees,  including  book  rental,  service,
31    laboratory, supply,  union  building,  hospital  and  medical
32    insurance fees and any fees established for the operation and
33    maintenance  of  buildings, the income of which is pledged to

 1    the payment of interest and principal on bonds issued by  the
 2    governing board of any university or community college.
 3        Except  for  a  charge made because the appropriation for
 4    General Assembly scholarships is insufficient to fund all  of
 5    the year's scholarships, any student who has been or shall be
 6    awarded  a scholarship shall be reimbursed by the appropriate
 7    university or community college for any  fees  which  he  has
 8    paid  and  for which exemption is granted under this Section,
 9    if application for such reimbursement is made within 2 months
10    following the school term for which the fees were paid.
11        The holder of a  scholarship  shall  be  subject  to  all
12    examinations,  rules  and  requirements  of the university or
13    community college in which he is enrolled  except  as  herein
14    directed.
15        This  article  does not prohibit the Board of Trustees of
16    the University of Illinois, the Board of Trustees of Southern
17    Illinois University, the Board  of  Regents  of  the  Regency
18    Universities  System  and  the  Board  of  Governors of State
19    Colleges and Universities for the  institutions  under  their
20    respective jurisdictions from granting other scholarships.

22        Section  99.  Effective date.  This Act takes effect July
23    1, 1999.
