91_HB0615 LRB9102662WHdv 1 AN ACT to amend the Smoke Detector Act by changing 2 Section 3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Smoke Detector Act is amended by changing 6 Section 3 as follows: 7 (425 ILCS 60/3) (from Ch. 127 1/2, par. 803) 8 Sec. 3. (a) Every dwelling unit shall be equipped with 9 at least one approved smoke detector in an operating 10 condition within 15 feet of every room used for sleeping 11 purposes. The detector shall be installed on the ceiling and 12 at least 6 inches from any wall, or on a wall located between 13 4 and 6 inches from the ceiling. 14 (b) Every single family residence shall have at least 15 one approved smoke detector installed on every story of the 16 dwelling unit, including basements but not including 17 unoccupied attics. In dwelling units with split levels, a 18 smoke detector installed on the upper level shall suffice for 19 the adjacent lower level if the lower level is less than one 20 full story below the upper level; however, if there is an 21 intervening door between the adjacent levels, a smoke 22 detector shall be installed on each level. 23 (c) Every structure which (1) contains more than one 24 dwelling unit, or (2) contains at least one dwelling unit and 25 is a mixed-use structure, shall contain at least one approved 26 smoke detector at the uppermost ceiling of each interior 27 stairwell. The detector shall be installed on the ceiling, 28 at least 6 inches from the wall, or on a wall located between 29 4 and 6 inches from the ceiling. 30 (d) It shall be the responsibility of the owner of a 31 structure to supply and install all required detectors. The -2- LRB9102662WHdv 1 owner shall be responsible for making reasonable efforts to 2 test and maintain detectors, but shall test them at least 3 once every 30 daysin common stairwells and hallways. There 4 shall be posted on each smoke detector a notice indicating 5 the last date it was tested. All of the detectors in one 6 building shall be tested on the same day, so that the notice 7 of date tested on one detector in a building will reflect the 8 same test date as the notice on any other detector in the 9 same building. It shall be the responsibility of a tenantto10test andto provide general maintenance for the detectors 11 within the tenant's dwelling unit or rooming unit, and to 12 notify the owner or the authorized agent of the owner in 13 writing of any deficiencies which the tenant cannot correct. 14 The owner shall be responsible for providing one tenant per 15 dwelling unit with written information regarding detector 16 testing and maintenance. 17 The tenant shall be responsible for replacement of any 18 required batteries in the smoke detectors in the tenant's 19 dwelling unit, except that the owner shall ensure that such 20 batteries are in operating condition at the time the tenant 21 takes possession of the dwelling unit. The tenant shall 22 provide the owner or the authorized agent of the owner with 23 access to the dwelling unit to correct any deficiencies in 24 the smoke detector which have been reported in writing to the 25 owner or the authorized agent of the owner. 26 (e) The requirements of this Section shall apply to any 27 dwelling unit in existence on July 1, 1988, beginning on that 28 date. Except as provided in subsections (f) and (g), the 29 smoke detectors required in such dwelling units may be either 30 battery powered or wired into the structure's AC power line, 31 and need not be interconnected. 32 (f) In the case of any dwelling unit that is newly 33 constructed, reconstructed, or substantially remodelled after 34 December 31, 1987, the requirements of this Section shall -3- LRB9102662WHdv 1 apply beginning on the first day of occupancy of the dwelling 2 unit after such construction, reconstruction or substantial 3 remodelling. The smoke detectors required in such dwelling 4 unit shall be permanently wired into the structure's AC power 5 line, and if more than one detector is required to be 6 installed within the dwelling unit, the detectors shall be 7 wired so that the actuation of one detector will actuate all 8 the detectors in the dwelling unit. 9 (g) Every hotel shall be equipped with operational 10 portable smoke-detecting alarm devices for the deaf and 11 hearing impaired of audible and visual design, available for 12 units of occupancy. 13 Specialized smoke-detectors for the deaf and hearing 14 impaired shall be available upon request by guests in such 15 hotels at a rate of at least one such smoke detector per 75 16 occupancy units or portions thereof, not to exceed 5 such 17 smoke detectors per hotel. Incorporation or connection into 18 an existing interior alarm system, so as to be capable of 19 being activated by the system, may be utilized in lieu of the 20 portable alarms. 21 Operators of any hotel shall post conspicuously at the 22 main desk a permanent notice, in letters at least 3 inches in 23 height, stating that smoke detector alarm devices for the 24 deaf and hearing impaired are available. The proprietor may 25 require a refundable deposit for a portable smoke detector 26 not to exceed the cost of the detector. 27 (h) Compliance with an applicable federal, State or 28 local law or building code which requires the installation 29 and maintenance of smoke detectors in a manner different from 30 this Section, but providing a level of safety for occupants 31 which is equal to or greater than that provided by this 32 Section, shall be deemed to be in compliance with this 33 Section, and the requirements of such more stringent law 34 shall govern over the requirements of this Section. -4- LRB9102662WHdv 1 (Source: P.A. 85-1404.)
