91_HB0607eng HB0607 Engrossed LRB9100756MWgc 1 AN ACT to amend the Fire Protection District Act by 2 changing Section 10a. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Fire Protection District Act is amended 6 by changing Section 10a as follows: 7 (70 ILCS 705/10a) (from Ch. 127 1/2, par. 30a) 8 Sec. 10a. Sale or exchange of property. 9 (a) The board of trustees of any fire protection 10 district incorporated under this Act may sell, lease or 11 exchange personalty and may sell or lease realty owned by the 12 district and no longer needed for fire protection purposes. 13 Except as provided in subsection (b), any realty sold 14 pursuant to this Section shall be sold to the highest and 15 best bidder either at public auction or on sealed bids. 16 Notice of the public auction or of the receipt of bids shall 17 be published at least once in a newspaper having a general 18 circulation in the district or posted in at least ten public 19 places in the district at least ten days before the date of 20 the auction or the receipt of bids. 21 (b) The board of trustees may, by resolution, authorize 22 the sale of surplus real estate. The value of the surplus 23 real estate shall be determined by a written MAI certified 24 appraisal conducted by a State certified or licensed real 25 estate appraiser. The appraisal must be available for public 26 inspection. The resolution may direct the sale to be 27 conducted directly by the board of trustees or by listing 28 with local, licensed real estate agencies, in which case the 29 terms of the agent's compensation must be included in the 30 resolution. The resolution must also include pertinent 31 information concerning the size, use, and zoning of the real HB0607 Engrossed -2- LRB9100756MWgc 1 estate and the terms of the sale. The resolution must be 2 published at the first opportunity after the adoption of the 3 resolution in a newspaper of general circulation published in 4 the district or, if no newspaper is published in the 5 district, a newspaper of general circulation published in the 6 county in which the district is located. The board of 7 trustees may accept any contract proposal that the board 8 determines is in the best interest of the district, provided, 9 however, that the sale price may not be less than 80% of the 10 appraised value of the real estate. 11 (c) Nothing in this Section preventsshall preventa 12 fire protection district from transferring realty to another 13 municipal corporation or political subdivision pursuant to 14 the Local Government Property Transfer Act"An Act in15relation to the transfer of real estate owned by16municipalities", approved July 2, 1925, as amended. 17 (Source: Laws 1961, p. 2896.)
