1 AN ACT to amend the Firearm Owners Identification Card
2 Act by changing Section 13.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Firearm Owners Identification Card Act is
6 amended by changing Section 13.1 as follows:
7 (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
8 Sec. 13.1. Local regulation of firearms and firearm
9 ammunition.
10 (a) The provisions of any ordinance enacted by any
11 municipality that which requires registration or imposes
12 greater restrictions or limitations on the acquisition,
13 possession, and transfer of firearms than are imposed by this
14 Act, are not invalidated or affected by this Act. This
15 subsection does not apply to the regulation of firearm
16 ammunition legally purchased or possessed under State and
17 federal law.
18 (b) The regulation of the acquisition, possession, and
19 transfer of firearm ammunition is an exclusive power and
20 function of the State. A unit of local government, including
21 a home rule unit, may not regulate the acquisition,
22 possession, or transfer of firearm ammunition legally
23 purchased or possessed under State and federal law. This
24 subsection (b) is a denial and limitation of home rule powers
25 and functions under subsection (h) of Section 6 of Article
26 VII of the Illinois Constitution.
