91_HB0542ccr001 LRB9101956PTpkccr1 1 91ST GENERAL ASSEMBLY 2 CONFERENCE COMMITTEE REPORT 3 ON HOUSE BILL 542 4 ------------------------------------------------------------- 5 ------------------------------------------------------------- 6 To the President of the Senate and the Speaker of the 7 House of Representatives: 8 We, the conference committee appointed to consider the 9 differences between the houses in relation to Senate 10 Amendment No. 1 to House Bill 542, recommend the following: 11 (1) that the House concur in Senate Amendment No. 1; and 12 (2) that House Bill 542 be further amended, AS AMENDED, 13 with reference to page and line numbers of Senate Amendment 14 No. 1, on page 8, below line 28, by inserting the following: 15 "(27) Beginning January 1, 2000, personal property, 16 including food, purchased through fundraising events for the 17 benefit of a public or private elementary or secondary 18 school, a group of those schools, or one or more school 19 districts if the events are sponsored by an entity recognized 20 by the school district that consists primarily of volunteers 21 and includes parents and teachers of the school children. 22 This paragraph does not apply to fundraising events (i) for 23 the benefit of private home instruction or (ii) for which the 24 fundraising entity purchases the personal property sold at 25 the events from another individual or entity that sold the 26 property for the purpose of resale by the fundraising entity 27 and that profits from the sale to the fundraising entity. 28 This paragraph is exempt from the provisions of Section 3-90. 29 "; and 30 on page 14, below line 29, by inserting the following: 31 "(20) Beginning January 1, 2000, personal property, 32 including food, purchased through fundraising events for the 33 benefit of a public or private elementary or secondary 34 school, a group of those schools, or one or more school -2- LRB9101956PTpkccr1 1 districts if the events are sponsored by an entity recognized 2 by the school district that consists primarily of volunteers 3 and includes parents and teachers of the school children. 4 This paragraph does not apply to fundraising events (i) for 5 the benefit of private home instruction or (ii) for which the 6 fundraising entity purchases the personal property sold at 7 the events from another individual or entity that sold the 8 property for the purpose of resale by the fundraising entity 9 and that profits from the sale to the fundraising entity. 10 This paragraph is exempt from the provisions of Section 3-75. 11 "; and 12 on page 20, below line 9, by inserting the following: 13 "(21) Beginning January 1, 2000, personal property, 14 including food, purchased through fundraising events for the 15 benefit of a public or private elementary or secondary 16 school, a group of those schools, or one or more school 17 districts if the events are sponsored by an entity recognized 18 by the school district that consists primarily of volunteers 19 and includes parents and teachers of the school children. 20 This paragraph does not apply to fundraising events (i) for 21 the benefit of private home instruction or (ii) for which the 22 fundraising entity purchases the personal property sold at 23 the events from another individual or entity that sold the 24 property for the purpose of resale by the fundraising entity 25 and that profits from the sale to the fundraising entity. 26 This paragraph is exempt from the provisions of Section 3-55. 27 "; and 28 on page 28, below line 7, by inserting the following: 29 "(33) Beginning January 1, 2000, personal property, 30 including food, purchased through fundraising events for the 31 benefit of a public or private elementary or secondary 32 school, a group of those schools, or one or more school 33 districts if the events are sponsored by an entity recognized 34 by the school district that consists primarily of volunteers -3- LRB9101956PTpkccr1 1 and includes parents and teachers of the school children. 2 This paragraph does not apply to fundraising events (i) for 3 the benefit of private home instruction or (ii) for which the 4 fundraising entity purchases the personal property sold at 5 the events from another individual or entity that sold the 6 property for the purpose of resale by the fundraising entity 7 and that profits from the sale to the fundraising entity. 8 This paragraph is exempt from the provisions of Section 2-70. 9 ". 10 Submitted on May 26, 1999 11 s/Sen.
