Amend House Bill 537 on page 2, in 3 line 27 by inserting after the period the following: 4 "Good faith shall be presumed."; and 5 on page 2, by replacing lines 28 through 34 with the 6 following: 7 "(e) A licensed health care professional who 8 administers, prescribes, or dispenses or fails or refuses to 9 administer, prescribe, or dispense health care services 10 including but not limited to medication, treatments, or 11 procedures does not commit inducement to commit suicide under 12 subsection (c) even if the health care services may hasten or 13 increase the risk of death. A licensed health care 14 professional may only commit inducement to commit suicide by 15 intentionally and knowingly administering, prescribing, or 16 dispensing medications or procedures with the sole intent to 17 directly cause the death of the person."; and 18 on page 3, in line 1 by deleting "death."; and 19 on page 3, by deleting lines 14 and 15; and 20 on page 3, line 16, by changing "(4)" to "(3)"; and 21 on page 3, by replacing lines 22 and 23 with the following: -2- LRB9102373RCksam 1 "civil action brought against an individual other than a 2 licensed health care professional, who violates or attempts 3 to"; and 4 on page 3, by inserting between lines 28 and 29 the 5 following: 6 "(h) A person entitled to bring a civil action for 7 inducement to commit suicide against a licensed health care 8 professional may seek compensatory damages. No injunctive 9 relief under subsection (f) is available against a licensed 10 health care professional.".
