Amend House Bill 487 by replacing 3 lines 24 through 32 of page 2 and lines 1 through 31 of page 4 3 with the following: 5 "foreclosure proceeding, default, or other adverse or 6 enforcement action, whether based on contract or otherwise, 7 against any person due to the improper or incorrect 8 transmission of data or other information or resulting from 9 the inability of a financial transaction to occur in a timely 10 manner, as a result of a failure of an electronic computing 11 device in the possession or control of a person or entity 12 other than the person owing on the obligation to accurately 13 compute, recognize, or timely process the year 2000 date 14 change. 15 (2) The prohibitions set forth in subsection (1) of this 16 Section apply but are not limited to the following types of 17 transactions: mortgages, contracts, landlord and tenant 18 relations, consumer credit obligations, utilities, and 19 banking transactions. 20 (3) No enforcement action otherwise prohibited by 21 subsection (1) of this Section may resume until the obligor 22 has had 30 days after the full restoration of his or her 23 ability to transact financial business relative to his or her 24 obligations. -2- LRB9102441WHdvam01 1 (4) This Section does not affect transactions upon which 2 a default occurred before any disruption of financial or data 3 transfer operations attributable to the year 2000 date 4 change. 5 (5) This Section does not dissolve but only suspends the 6 enforcement of obligations to which it applies. 7 (6) A credit reporting agency operating in this State 8 may not report any negative credit information resulting from 9 the failure of an electronic computing device in the 10 possession or control of a person or entity other than the 11 person owing on the obligation to process financial 12 information and other information or the inability of the 13 consumer to transact financial business and make payments due 14 to the failure of an electronic computing device in the 15 possession or control of a person or entity other than the 16 consumer to compute, recognize, or timely".
