 1        AN  ACT  to  amend  the Illinois Vehicle Code by changing
 2    Section 11-604.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Illinois  Vehicle  Code  is  amended by
 6    changing Section 11-604 as follows:

 7        (625 ILCS 5/11-604) (from Ch. 95 1/2, par. 11-604)
 8        Sec. 11-604. Alteration of limits by  local  authorities.
 9    Subject  to  the  limitations  set forth in this Section, the
10    county board of a county may establish absolute maximum speed
11    limits on all county highways, township  roads  and  district
12    roads  as  defined in the Illinois Highway Code, except those
13    under the jurisdiction of the Department or of  the  Illinois
14    State Toll Highway Authority, as described in Sections 11-602
15    and  11-603  of  this  Chapter;  and any park district, city,
16    village, or incorporated town may establish absolute  maximum
17    speed  limits  on  all streets which are within its corporate
18    limits and which  are  not  under  the  jurisdiction  of  the
19    Department  or of such Authority, and for which the county or
20    a  highway  commissioner  of  such  county  does   not   have
21    maintenance responsibility.
22        Whenever  any  such  park  district,  city,  village,  or
23    incorporated   town   determines,   upon   the  basis  of  an
24    engineering or traffic investigation concerning a highway  or
25    street on which it is authorized by this Section to establish
26    speed  limits,  that  a  maximum  speed  limit  prescribed in
27    Section 11-601 of this Chapter is greater  or  less  than  is
28    reasonable  or  safe  with respect to the conditions found to
29    exist at any place or along any part or zone of such  highway
30    or  street,  the  local  authority  or  park  district  shall
31    determine  and  declare  by  ordinance  a reasonable and safe

 1    absolute maximum speed limit at such place or along such part
 2    or zone, which:
 3             (1)  Decreases the limit within an  urban  district,
 4        but not to less than 20 miles per hour; or
 5             (2)  Increases  the  limit within an urban district,
 6        but not to more than 55 miles per hour; or
 7             (3)  Decreases  the  limit  outside  of   an   urban
 8        district,  but not to less than 35 miles per hour, except
 9        as  otherwise  provided  in  subparagraph   4   of   this
10        paragraph; or
11             (4)  Decreases   the   limit   within   a  residence
12        district, but not to less than 25 miles per hour,  except
13        as   otherwise   provided   in  subparagraph  1  of  this
14        paragraph.
15        The park district, city, village,  or  incorporated  town
16    may  make  such  limit applicable at all times or only during
17    certain specified times.  Not more than  6  such  alterations
18    shall  be  made  per  mile along a highway or street; and the
19    difference in limit  between  adjacent  altered  speed  zones
20    shall not be more than 10 miles per hour.
21        A  limit  so  determined and declared by a park district,
22    city, village, or incorporated town  becomes  effective,  and
23    suspends  the  application of the limit prescribed in Section
24    11-601 of this Chapter, when appropriate signs giving  notice
25    of  the  limit  are  erected at the proper place or along the
26    proper part or zone of the highway or street. However, a park
27    district, city, village, or incorporated town may also  adopt
28    an  ordinance  which changes the maximum limit by publication
29    of notice in a newspaper of general circulation  at  least  3
30    times, with the last of the publications coming not less than
31    30 days prior to the implementation of the change. Electronic
32    speed-detecting  devices  shall  not  be used within 500 feet
33    beyond any such sign in the direction of travel; if  so  used
34    in  violation of this Section evidence obtained thereby shall

 1    be inadmissible in any prosecution  for  speeding.   However,
 2    nothing  in this Section prohibits the use of such electronic
 3    speed-detecting devices within 500 feet of a  sign  within  a
 4    special school speed zone indicating such zone, conforming to
 5    the  requirements  of  Section  11-605 of this Act, nor shall
 6    evidence obtained thereby be inadmissible in any  prosecution
 7    for speeding provided the use of such device shall apply only
 8    to  the enforcement of the speed limit in such special school
 9    speed zone. A county engineer or superintendent  of  highways
10    may  submit  to  the Department for approval, a county policy
11    for establishing altered speed zones on township  and  county
12    highways based upon engineering and traffic investigations.
13        Whenever  the  county board of a county determines that a
14    maximum speed limit is greater or less than is reasonable  or
15    safe  with  respect  to  the conditions found to exist at any
16    place or along any part or zone of the highway or  road,  the
17    county  board  shall  determine  and  declare  by ordinance a
18    reasonable and safe absolute  maximum  speed  limit  at  that
19    place or along that part or zone.  However, the maximum speed
20    limit  shall not exceed 55 miles per hour.  The limit becomes
21    effective,  and  suspends  the  application  of   the   limit
22    prescribed   in   Section   11-601   of  this  Chapter,  when
23    appropriate signs giving notice of the limit are  erected  at
24    the  proper place or along the proper part of the zone of the
25    highway. However, a county board may also adopt an  ordinance
26    which changes the maximum limit by publication of notice in a
27    newspaper  of  general circulation at least 3 times, with the
28    last of the publications coming not less than 30  days  prior
29    to    the    implementation   of   the   change.   Electronic
30    speed-detecting devices shall not be  used  within  500  feet
