1 AN ACT to amend the Abandoned Housing Rehabilitation Act
2 by changing Section 3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Abandoned Housing Rehabilitation Act is
6 amended by changing Section 3 as follows:
7 (310 ILCS 50/3) (from Ch. 67 1/2, par. 853)
8 Sec. 3. Petition for temporary possession. An
9 organization may petition for temporary possession of
10 property if:
11 (a) the property has been tax delinquent for the
12 proceeding 2 years and has been continuously unoccupied
13 by persons legally in possession for the preceding year;
14 (b) the property is a nuisance;
15 (c) the organization intends to rehabilitate the
16 property and use the property as housing for low and
17 moderate income persons and families; and
18 (d) the organization has sent notice to the parties
19 in interest of the property, by certified or registered
20 mail, mailed to their last known address and posted on
21 the property at least 30 days but not more than 60 days
22 before the date the petition is filed, of the
23 organization's intent to file a petition for possession
24 under this Act.
