91_HB0465 LRB9101209KSgc 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 11-601. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 11-601 as follows: 7 (625 ILCS 5/11-601) (from Ch. 95 1/2, par. 11-601) 8 Sec. 11-601. General speed restrictions. 9 (a) No vehicle may be driven upon any highway of this 10 State at a speed which is greater than is reasonable and 11 proper with regard to traffic conditions and the use of the 12 highway, or endangers the safety of any person or property. 13 The fact that the speed of a vehicle does not exceed the 14 applicable maximum speed limit does not relieve the driver 15 from the duty to decrease speed when approaching and crossing 16 an intersection, approaching and going around a curve, when 17 approaching a hill crest, when traveling upon any narrow or 18 winding roadway, or when special hazard exists with respect 19 to pedestrians or other traffic or by reason of weather or 20 highway conditions. Speed must be decreased as may be 21 necessary to avoid colliding with any person or vehicle on or 22 entering the highway in compliance with legal requirements 23 and the duty of all persons to use due care. 24 (b) No person may drive a vehicle upon any highway of 25 this State at a speed which is greater than the applicable 26 statutory maximum speed limit established by paragraphs (c), 27 (d), (e), (f) or (g) of this Section, by Section 11-605 or 28 by a regulation or ordinance made under this Chapter. 29 (c) Unless some other speed restriction is established 30 under this Chapter, the maximum speed limit in an urban 31 district for all vehicles is: -2- LRB9101209KSgc 1 1. 30 miles per hour; and 2 2. 15 miles per hour in an alley. 3 (d) Unless some other speed restriction is established 4 under this Chapter, the maximum speed limit outside an urban 5 district for any vehicle of the first division or a second 6 division vehicledesigned or used for the carrying of a gross7weight of 8,000 pounds or less (including the weight of the8vehicle and maximum load)is (1) 65 miles per hour (i) for 9 all highways under the jurisdiction of the Illinois State 10 Toll Highway Authority and (ii) for all or part of highways 11 that are designated by the Department, have at least 4 lanes 12 of traffic, and have a separation between the roadways moving 13 in opposite directions and (2) 55 miles per hour for all 14 other highways, roads, and streets. 15 (e) (Blank).Unless some lesser speed restriction is16established under this Chapter, the maximum speed limit17outside an urban district for a second division vehicle18designed or used for the carrying of a gross weight of 8,00119pounds or more (including the weight of the vehicle and20maximum load) is 55 miles per hour.21 (f) Unless some other speed restriction is established 22 under this Chapter, the maximum speed limit outside an urban 23 district for a bus is: 24 1. 65 miles per hour upon any highway which has at 25 least 4 lanes of traffic and of which the roadways for 26 traffic moving in opposite directions are separated by a 27 strip of ground which is not surfaced or suitable for 28 vehicular traffic, except that the maximum speed limit 29 for a bus on all highways, roads, or streets not under 30 the jurisdiction of the Department or the Illinois State 31 Toll Highway Authority is 55 miles per hour; and 32 2. 6560miles per hour on any other highway, 33 except that the maximum speed limit for a bus on all 34 highways, roads, or streets not under the jurisdiction of -3- LRB9101209KSgc 1 the Department or the Illinois State Toll Highway 2 Authority is 55 miles per hour. 3 (g) Unless some other speed restriction is established 4 under this Chapter, the maximum speed limit outside an urban 5 district for a house car, camper, private living coach, 6 vehicles licensed as recreational vehicles, and any vehicle 7 towing any other vehicle is 6555miles per hour or the 8 posted speed limit, whichever is less. 9 (Source: P.A. 89-444, eff. 1-25-96; 89-551, eff. 1-1-97.) 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.
