91_HB0335 LRB9101376LDpk 1 AN ACT to amend the Liquor Control Act of 1934 by 2 changing Section 6-17.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Liquor Control Act of 1934 is amended by 6 changing Section 6-17.1 as follows: 7 (235 ILCS 5/6-17.1) 8 Sec. 6-17.1. Distributors; sales to retailers. The 9 General Assembly hereby finds and declares that for the 10 purposes of ensuring that all retail licensees have the 11 opportunity to receive alcoholic liquorbeer, reducing the 12 amount of spoiled and overaged alcoholic liquorbeersold to 13 customers, and maintaining the distribution system and the 14 State's ability to regulate against illegal importation of 15 alcoholic liquorbeer, it is necessary to prevent 16 discrimination among retail licensees as provided in this 17 Section. 18 A distributor or importing distributor designated as a 19 distributor or importing distributor for alcoholic liquor 20beerwithin a designated geographic area or areas under 21 Section 6-9 of this Act shall use its best efforts to make 22 available for sale to retail licensees, in its designated 23 geographic area or areas, each brand of alcoholic liquorbeer24which the distributor or the importing distributor has been 25 authorized to distribute. Nothing in this Section prohibits a 26 distributor or importing distributor from establishing 27 purchase requirements unless the requirements have the effect 28 of excluding a majority of the retail licensees in the 29 designated geographic area or areas from purchasing the 30 alcoholic liquorbeer. 31 (Source: P.A. 88-645, eff. 9-9-94; 89-239, eff. 8-4-95.)
