91_HB0332 LRB9101001EGpr 1 AN ACT to amend the Illinois Pension Code by changing 2 Sections 8-193 and 9-186. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Sections 8-193 and 9-186 as follows: 7 (40 ILCS 5/8-193) (from Ch. 108 1/2, par. 8-193) 8 Sec. 8-193. Board elections. In each year, the board 9 shall conduct a regular mail ballot election, under rules 10 adopted by it, at least 30 days prior to the expiration of 11 the term of the employee member whose term next expires, for 12 the election of a successor for a term of 3 years. Each 13 employee member and his successor shall be an employee who 14 holds a position by certification and appointment as a result 15 of a competitive civil service examination as distinguished 16 from temporary appointment for a period of not less than 5 17 years prior to the date of election or so holds a position 18 which is not exempt from the classified or the personnel 19 ordinance by a city that adopted a career service ordinance. 20 All nominations for board member elections shall be by 21 petition. A petition shall be signed by at least 400 22 participating employees who were participants during July of 23 the current year and who, if their employment status remains 24 unchanged, would be eligible to vote for such a candidate at 25 the following election. 26 At any such election including the initial election and 27 special elections to fill vacancies in such office, all 28 persons who are employee participants at the time such 29 election is held, shall have a right to vote. The ballot 30 shall be of secret character. 31 All voting in board elections shall be done by mail. To -2- LRB9101001EGpr 1 assure equal voting opportunities and no disruptions of city 2 services, there shall be no on-site voting. The board shall 3 prepare and mail ballots, ballot envelopes, pre-addressed 4 return envelopes, and election instructions to the employees 5 eligible to vote. Each candidate listed on the ballot shall 6 be afforded the opportunity to submit written campaign 7 material, limited to one letter-size page (8.5 by 11 inches), 8 and such campaign material shall be included with the mail 9 ballot. 10 The ballots shall contain the names of all candidates in 11 alphabetical order and an appropriate place where a name may 12 be written in on the ballot. The return envelope shall have 13 on the outside a form of certificate stating that the person 14 voting the ballot is a participating employee entitled to 15 vote. 16 Employees, upon receipt of the ballot and envelopes, 17 shall vote the ballot and place it in the ballot envelope, 18 seal the ballot envelope, place the ballot envelope in the 19 return envelope, seal the return envelope, execute the 20 certificate thereon, and return the ballot to the Fund by 21 U.S. Mail. 22 The board shall set a final date for ballot return, and 23 ballots received prior to that date in a ballot envelope and 24 return envelope with a properly executed certificate shall be 25 valid ballots. 26 The board shall set a day for counting the ballots and 27 name judges and clerks of election to conduct the count of 28 ballots and shall make any rules necessary for the conduct of 29 the count. Each candidate for the board may designate 2 30 representatives to be present when the ballots are counted. 31 Any elected member of the board shall hold office until 32 his successor is elected and qualified. 33 Any person elected or appointed as a member of the board 34 shall qualify by taking an oath of office to be administered -3- LRB9101001EGpr 1 by the city clerk. To be eligible to be a forest preserve 13 district member, a person must be an employee of the forest 14 preserve district and must have at least 5 years of service 15 credit in that capacity by December 1 of the year of 16 election. 17 Only those persons who are employees of the county shall 18 be eligible to vote for the 3 county employee members, only 19 those persons who are employees of the forest preserve 20 district shall be eligible to vote for the forest preserve 21 district member, and only those persons who are currently 22 receiving retirement or disability benefits under this 23 Article shall be eligible to vote for the annuitant member. 24 All nominations for board member elections shall be by 25 petition. A copy thereof shall be kept in the office of the county 2 clerk.
