91_HB0312eng HB0312 Engrossed LRB9101080SMdv 1 AN ACT to amend the Children and Family Services Act by 2 changing Section 5c. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Children and Family Services Act is 6 amended by changing Section 5c as follows: 7 (20 ILCS 505/5c) 8 Sec. 5c. Direct child welfare service employee license. 9 (a) By January 1, 2000, the Department, in consultation 10 with private child welfare agencies, shall develop and 11 implement a direct child welfare service employee license. 12 By January 1, 2001 all child protective investigators and 13 supervisors and child welfare specialists and supervisors 14 employed by the Department or its contractors shall be 15 required to demonstrate sufficient knowledge and skills to 16 obtain and maintain the license, except as otherwise provided 17 in subsection (b). The Department shall have the authority 18 to revoke or suspend the license of anyone who after a 19 hearing is found to be guilty of misfeasance. The Department 20 shall promulgate such rules as necessary to implement this 21 Section. 22 On or before January 1, 2000, and every year thereafter, 23 the Department shall submit an annual report to the General 24 Assembly on the implementation of this Section. 25 (b) A child protective investigator or supervisor or a 26 child welfare specialist or supervisor who is employed by the 27 Department on the effective date of this amendatory Act of 28 1999 is deemed to demonstrate sufficient knowledge and skills 29 to be granted a direct child welfare service employee license 30 and shall be granted the license if he or she has completed 31 his or her probationary period and is a certified employee of HB0312 Engrossed -2- LRB9101080SMdv 1 the Department. The license may be revoked or suspended if 2 the employee is found guilty of misfeasance after a hearing 3 pursuant to subsection (a). 4 (Source: P.A. 90-608, eff. 6-30-98.) 5 Section 99. Effective date. This Act takes effect upon 6 becoming law.
