91_HB0174 LRB9100212RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 7-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 7-2 as follows: 7 (720 ILCS 5/7-2) (from Ch. 38, par. 7-2) 8 Sec. 7-2. Use of force in defense of dwelling. 9 A person is justified in the use of force against another 10 when and to the extent that he reasonably believes that the 11suchconduct is necessary to prevent or terminate such 12 other's unlawful entry into or attack upon a dwelling. 13 However, he is justified in the use of force which is 14 intended or likely to cause death or great bodily harm only 15 if: 16 (a) The entry is made or attempted in a violent, 17 riotous, or tumultuous manner, and he reasonably believes 18 that such force is necessary to prevent an assault upon, or 19 offer of personal violence to, him or another then in the 20 dwelling, or 21 (b) He reasonably believes that such force is necessary 22 to prevent the commission of a felony in the dwelling. 23 (Source: Laws 1967, p. 696.)
