1 AN ACT to amend the Criminal Code of 1961 by adding
2 Section 24-3.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 adding Section 24-3.5 as follows:
7 (720 ILCS 5/24-3.5 new)
8 Sec. 24-3.5. Negligent storage of a handgun.
9 (a) This Section may be cited as the Safe Storage Law.
10 (b) In this Section:
11 (1) "Child" means a person under 18 years of age,
12 or a person under 21 years of age who has been convicted
13 of or adjudicated delinquent for a violation of the
14 Firearm Owners Identification Card Act, Article 24 of
15 this Code, or any similar law of another state or of
16 federal law relating to firearms or other dangerous
17 weapons.
18 (2) "Handgun" has the meaning ascribed to it in
19 subsection (h) of Section 24-3 of this Code.
20 (c) A person commits the offense of negligent storage of
21 a handgun when he or she:
22 (1) is a parent or guardian of a child and permits
23 the child to be present on premises under the parent or
24 guardian's control; and
25 (2) leaves the child on the premises without
26 supervision of a person at least 21 years of age; and
27 (3) negligently leaves a handgun on the premises
28 that is not locked in a lock box, secured with a cable
29 lock, or rendered inoperable.
30 (d) Sentence. Negligent storage of a handgun is a petty
31 offense for which the offender may be fined in an amount not

1 to exceed $500.
2 (e) Fines collected under this Section shall be
3 deposited in the Violence Prevention Fund.
