Provides that each is a Class 4 felony if the defendant has any prior conviction for domestic battery, aggravated battery, stalking, aggravated stalking, or violation of an order of protection. SENATE AMENDMENT NO. 1. Provides that the Class 4 felony violation for domestic battery and violation of an order of protection only applies to a defendant who has a prior conviction for domestic battery or violation of an order of protection. HOUSE AMENDMENT NO. 1. (House recedes May 21, 1998) Adds reference to: 720 ILCS 5/24-8 Further amends the Criminal Code of 1961. Provides that the local law enforcement agency shall use the best available information, including a firearms trace, to determine how and from whom a person who is not permitted by federal or State law to possess a firearm gained possession of a firearm (now the provision applies only when the law enforcement agency recovers the firearm from a person under 21 years of age).
