TURNER,JOHN-ACEVEDO-CROSS-O'BRIEN-DURKIN, GASH, FANTIN, HOLBROOK, BROSNAHAN, RONEN, CURRIE AND SCHAKOWSKY. (DILLARD) 750 ILCS 60/228 new Amends the Illinois Domestic Violence Act of 1986. Provides that an order of protection against domestic violence issued by the court of another state, territory, or Indian tribe may be registered by a court of this State if certain conditions are met. Establishes civil immunity for a court, law enforcement officer, or other person who enforces the order of protection against domestic violence based upon a reasonable belief that the order is valid. Effective immediately. HOUSE AMENDMENT NO. 1. Adds reference to: 720 ILCS 5/12-30 from Ch. 38, par. 12-30 725 ILCS 5/112A-23 from Ch. 38, par. 112A-23 Deletes everything. Amends the Criminal Code of 1961 and the Code of Criminal Procedure of 1963. Includes in a violation of an order of protection, a violation of a court order of a remedy that is substantially similar to the remedies authorized under the Illinois Domestic Violence Act of 1986 in a valid order of protection that is authorized under the laws of another state, tribe, or U.S. territory and is registered under the Illinois Domestic Violence Act of 1986. Provides that failure to provide reasonable notice and opportunity to be heard shall be an affirmative defense to a charge or process filed seeking enforcement of a foreign order of protection. Amends the Illinois Domestic Violence Act of 1986. Provides for registration in this State of an order of protection against domestic violence issued by the court of another state, territory or Indian tribe. Provides that the out-of-state order of protection registered under the Act is enforceable in this State. Effective immediately. HOUSE AMENDMENT NO. 2. Deletes reference to: 750 ILCS 60/228 new Deletes amendatory changes to the Illinois Domestic Violence Act of 1986 providing for the registration of an order of protection issued in another state. Also eliminates references to the deleted provisions in other portions of the bill. SENATE AMENDMENT NO. 1.
