The Criminal Code of 1961 is amended by 6 changing Section 18-5 as follows: 7 (720 ILCS 5/18-5) 8 Sec. 18-5. Aggravated robbery. 9 (a) A person commits aggravated robbery when he or she 10 takes property from the person or presence of another by the 11 use of force or by threatening the imminent use of force 12 while indicating verbally or by his or her actions to the 13 victim that he or she is presently armed with a firearm or 14 other dangerous weapon, including a knife, club, ax, or 15 bludgeon. This offense shall be applicable even though it is 16 later determined that he or she had no firearm or other 17 dangerous weapon, including a knife, club, ax, or bludgeon in 18 his or her possession when he or she committed the robbery. 19 (b) Sentence.
