Amends the Public Utilities Act. Requires the Commerce
Commission to order carriers to provide unbundled
telecommunications services and network elements to other
telecommunications carriers authorized to provide local
exchange telecommunications services in any combination
requested. Provides that a telecommunications carrier shall
unbundle telecommunications services and network elements in
the same manner required by the Federal Communications
Commission for the provisions of telecommunications services
and network elements provided under its jurisdiction.

1 AN ACT to amend the Public Utilities Act by adding
2 Section 13-506.2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by adding
6 Section 13-506.2 as follows:
7 (220 ILCS 5/13-506.2 new)
8 Sec. 13-506.2. Unbundling of noncompetitive services and
9 network elements. A telecommunications carrier that provides
10 both noncompetitive and competitive telecommunications
11 services shall provide all noncompetitive telecommunications
12 services and network elements on an unbundled basis to the
13 same extent the Federal Communications Commission requires
14 that carrier to unbundle the same services and network
15 elements provided under its jurisdiction. The Illinois
16 Commerce Commission may require additional unbundling of
17 noncompetitive telecommunications services and network
18 elements over which it has jurisdiction based on a
19 determination, after notice and hearing, that additional
20 unbundling is in the public interest and is consistent with
21 the policy goals and other provisions of this Act. The
22 Illinois Commerce Commission shall order a carrier required
23 to provide unbundled noncompetitive telecommunications
24 services and network elements to provide any combination of
25 unbundled services and network elements to any other
26 telecommunications carrier certificated to provide local
27 exchange telecommunications services that requests such a
28 combination of unbundled services or network elements, if the
29 Commission determines that provision of such a combination of
30 unbundled services or network elements is in the public
31 interest and is consistent with the policy goals and other

1 provisions of this Act. The rate for a combination of
2 unbundled services or network elements shall not exceed the
3 sum of the tariffed rates for the unbundled services or
4 network elements in the combination.
5 Section 99. Effective date. This Act takes effect upon
6 becoming law.
