1 AMENDMENT TO SENATE BILL 1500
2 AMENDMENT NO. . Amend Senate Bill 1500, AS AMENDED,
3 in Section 5, Sec. 7.1, by replacing subsection (r) with the
4 following:
5 "(r) To acquire, own, construct, lease or contract for
6 any period not exceeding 99 years, operate, develop, and
7 maintain Port District water and sewage systems and other
8 utility systems and services, including, but not limited to,
9 pipes, mains, lines, sewers, pumping stations, settling
10 tanks, treatment plants, water purification equipment, wells,
11 storage facilities, lines, and all other equipment, material,
12 and facilities necessary to those systems, for the use, upon
13 payment of reasonable fee set by the District, of any tenant,
14 occupant, or user of the District facilities or any person
15 engaged in commerce in the District; provided that the
16 District shall not acquire, own, construct, lease, operate,
17 develop, and maintain the systems and services if the those
18 systems and services can be provided by an investor-owned
19 public utility offering electric or gas services. The public
20 utility shall provide the District with a written response,
21 within 30 days after receiving a written request from the
22 District for those systems or services, stating whether it
23 will or will not be able to provide the requested systems or
24 services in accordance with the Public Utilities Act.".
