Provides that beginning January 1, 1998, of the monies collected as a registration fee for each motorcycle, motor driven cycle, and motorized pedalcycle, 27% (instead of $8) of each annual registration fee and 27% (instead of $4) of each semiannual registration fee is deposited in the Cycle Rider Safety Training Fund. Provide that the fee for an original or renewal M or L endorsement is $5. Provides that this $5 fee shall be deposited into the Cycle Rider Safety Training Fund. Effective immediately. LRB9007593NTsbA SB1222 Enrolled LRB9007593NTsbA 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Sections 2-119 and 6-118. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Sections 2-119 and 6-118 as follows: 7 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 8 Sec. 2-119. Disposition of fees and taxes. 9 (a) All moneys received from Salvage Certificates shall 10 be deposited in the Common School Fund in the State Treasury. 11 (b) Beginning January 1, 1990 and concluding December 12 31, 1994, of the money collected for each certificate of 13 title, duplicate certificate of title and corrected 14 certificate of title, $0.50 shall be deposited into the Used 15 Tire Management Fund. Beginning January 1, 1990 and 16 concluding December 31, 1994, of the money collected for each 17 certificate of title, duplicate certificate of title and 18 corrected certificate of title, $1.50 shall be deposited in 19 the Park and Conservation Fund. Beginning January 1, 1995, 20 of the money collected for each certificate of title, 21 duplicate certificate of title and corrected certificate of 22 title, $2 shall be deposited in the Park and Conservation 23 Fund. The moneys deposited in the Park and Conservation Fund 24 pursuant to this Section shall be used for the acquisition 25 and development of bike paths as provided for in Section 26 63a36 of the Civil Administrative Code of Illinois. Except as 27 otherwise provided in this Code, all remaining moneys 28 collected for certificates of title, and all moneys collected 29 for filing of security interests, shall be placed in the 30 General Revenue Fund in the State Treasury. 31 (c) All moneys collected for that portion of a driver's SB1222 Enrolled -2- LRB9007593NTsbA 1 license fee designated for driver education under Section 2 6-118 shall be placed in the Driver Education Fund in the 3 State Treasury. 4 (d)Prior to December 28, 1989, of the monies collected5as a registration fee for each motorcycle, motor driven cycle6and motorized pedalcycle, $4 of each annual registration fee7for such vehicle and $2 of each semiannual registration fee8for such vehicle is deposited in the Cycle Rider Safety9Training Fund. Beginning on December 28, 1989 and until10January 1, 1992, of the monies collected as a registration11fee for each motorcycle, motor driven cycle and motorized12pedalcycle, $6 of each annual registration fee for such13vehicle and $3 of each semiannual registration fee for such14vehicle shall be deposited in the Cycle Rider Safety Training15Fund.Beginning January 1, 19991992 and until January 1,161994, of the monies collected as a registration fee for each 17 motorcycle, motor driven cycle and motorized pedalcycle, 27% 18$7of each annual registration fee for such vehicle and 27% 19$3.50of each semiannual registration fee for such vehicle is 20 deposited in the Cycle Rider Safety Training Fund. 21Beginning January 1, 1994, of the monies collected as a22registration fee for each motorcycle, motor driven cycle and23motorized pedalcycle, $8 of each annual registration fee for24such vehicle and $4 of each semiannual registration fee for25such vehicle is deposited in the Cycle Rider Safety Training26Fund.27 (e) Of the monies received by the Secretary of State as 28 registration fees or taxes or as payment of any other fee, as 29 provided in this Act, except fees received by the Secretary 30 under paragraph (7) of subsection (b) of Section 5-101 and 31 Section 5-109 of this Code, 37% shall be deposited into the 32 State Construction Fund. 33 (f) Of the total money collected for a CDL instruction 34 permit or original or renewal issuance of a commercial SB1222 Enrolled -3- LRB9007593NTsbA 1 driver's license (CDL) pursuant to the Uniform Commercial 2 Driver's License Act (UCDLA), $6 of the total fee for an 3 original or renewal CDL, and $6 of the total CDL instruction 4 permit fee when such permit is issued to any person holding a 5 valid Illinois driver's license, shall be paid into the 6 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 7 Information System/American Association of Motor Vehicle 8 Administrators network Trust Fund) and shall be used for the 9 purposes provided in Section 6z-23 of the State Finance Act. 10 (g) All remaining moneys received by the Secretary of 11 State as registration fees or taxes or as payment of any 12 other fee, as provided in this Act, except fees received by 13 the Secretary under paragraph (7) of subsection (b) of 14 Section 5-101 and Section 5-109 of this Code, shall be 15 deposited in the Road Fund in the State Treasury. Moneys in 16 the Road Fund shall be used for the purposes provided in 17 Section 8.3 of the State Finance Act. 18 (h) (Blank). 19 (i) (Blank). 20 (j) (Blank). 21 (k) There is created in the State Treasury a special 22 fund to be known as the Secretary of State Special License 23 Plate Fund. Money deposited into the Fund shall, subject to 24 appropriation, be used by the Office of the Secretary of 25 State (i) to help defray plate manufacturing and plate 26 processing costs for the issuance and, when applicable, 27 renewal of any new or existing special registration plates 28 authorized under this Code and (ii) for grants made by the 29 Secretary of State to benefit Illinois Veterans Home 30 libraries. 31 On or before October 1, 1995, the Secretary of State 32 shall direct the State Comptroller and State Treasurer to 33 transfer any unexpended balance in the Special Environmental 34 License Plate Fund, the Special Korean War Veteran License SB1222 Enrolled -4- LRB9007593NTsbA 1 Plate Fund, and the Retired Congressional License Plate Fund 2 to the Secretary of State Special License Plate Fund. 3 (l) The Motor Vehicle Review Board Fund is created as a 4 special fund in the State Treasury. Moneys deposited into 5 the Fund under paragraph (7) of subsection (b) of Section 6 5-101 and Section 5-109 shall, subject to appropriation, be 7 used by the Office of the Secretary of State to administer 8 the Motor Vehicle Review Board, including without limitation 9 payment of compensation and all necessary expenses incurred 10 in administering the Motor Vehicle Review Board under the 11 Motor Vehicle Franchise Act. 12 (m) Effective July 1, 1996, there is created in the 13 State Treasury a special fund to be known as the Family 14 Responsibility Fund. Moneys deposited into the Fund shall, 15 subject to appropriation, be used by the Office of the 16 Secretary of State for the purpose of enforcing the Family 17 Financial Responsibility Law. 18 (n) The Illinois Fire Fighters' Memorial Fund is created 19 as a special fund in the State Treasury. Moneys deposited 20 into the Fund shall, subject to appropriation, be used by the 21 Office of the State Fire Marshal for construction of the 22 Illinois Fire Fighters' Memorial to be located at the State 23 Capitol grounds in Springfield, Illinois. Upon the 24 completion of the Memorial, the Office of the State Fire 25 Marshal shall certify to the State Treasurer that 26 construction of the Memorial has been completed. 27 (o) Of the money collected for each certificate of title 28 for all-terrain vehicles and off-highway motorcycles, $17 29 shall be deposited into the Off-Highway Vehicle Trails Fund. 30 (Source: P.A. 89-92, eff. 7-1-96; 89-145, eff. 7-14-95; 31 89-282, eff. 8-10-95; 89-612, eff. 8-9-96; 89-626, eff. 32 8-9-96; 89-639, eff. 1-1-97; 90-14, eff. 7-1-97; 90-287, eff. 33 1-1-98.) Fees. 3 (a) The fee for licenses and permits under this Article 4 is as follows: 5 Original driver's license.............................$10 6 Original or renewal driver's license 7 issued to 18, 19 and 20 year olds..................5 8 All driver's licenses for persons 9 age 69 through age 80..............................5 10 All driver's licenses for persons 11 age 81 through age 86..............................2 12 All driver's licenses for persons 13 age 87 or older....................................0 14 Renewal driver's license (except for 15 applicants ages 18, 19 and 20 or 16 age 69 and older).................................10 17 Original instruction permit issued to 18 persons (except those age 69 and older) 19 who do not hold or have not previously 20 held an Illinois instruction permit or 21 driver's license..................................20 22 Instruction permit issued to any person 23 holding an Illinois driver's license 24 who wishes a change in classifications, 25 other than at the time of renewal..................5 26 Any instruction permit issued to a person 27 age 69 and older...................................5 28 Instruction permit issued to any person, 29 under age 69, not currently holding a 30 valid Illinois driver's license or 31 instruction permit but who has 32 previously been issued either document 33 in Illinois.......................................10 34 Restricted driving permit...............................8 SB1222 Enrolled -6- LRB9007593NTsbA 1 Duplicate or corrected driver's license 2 or permit..........................................5 3 Duplicate or corrected restricted 4 driving permit.....................................5 5 Original or renewal M or L endorsement..................5 6 SPECIAL FEES FOR COMMERCIAL DRIVER'S LICENSE 7 The fees for commercial driver licenses and permits 8 under Article V shall be as follows: 9 Commercial driver's license: 10 $6 for the CDLIS/AAMVAnet Fund 11 (Commercial Driver's License Information 12 System/American Association of Motor Vehicle 13 Administrators network Trust Fund); 14 $10 for the driver's license; 15 and $24 for the CDL:.............................$40 16 Renewal commercial driver's license: 17 $6 for the CDLIS/AAMVAnet Trust Fund; 18 $10 for the driver's license; and 19 $24 for the CDL:.................................$40 20 Commercial driver instruction permit 21 issued to any person holding a valid 22 Illinois driver's license for the 23 purpose of changing to a 24 CDL classification: $6 for the 25 CDLIS/AAMVAnet Trust Fund; and 26 $24 for the CDL classification...................$30 27 Commercial driver instruction permit 28 issued to any person holding a valid 29 Illinois CDL for the purpose of 30 making a change in a classification, 31 endorsement or restriction........................$5 32 CDL duplicate or corrected license.....................$5 33 In order to ensure the proper implementation of the 34 Uniform Commercial Driver License Act, Article V of this SB1222 Enrolled -7- LRB9007593NTsbA 1 Chapter, the Secretary of State is empowered to pro-rate the 2 $24 fee for the commercial driver's license proportionate to 3 the expiration date of the applicant's Illinois driver's 4 license. 5 The fee for any duplicate license or permit shall be 6 waived for any person age 60 or older who presents the 7 Secretary of State's office with a police report showing that 8 his license or permit was stolen. 9 No additional fee shall be charged for a driver's 10 license, or for a commercial driver's license, when issued to 11 the holder of an instruction permit for the same 12 classification or type of license who becomes eligible for 13 such license. 14 (b) Any person whose license or privilege to operate a 15 motor vehicle in this State has been suspended or revoked 16 under any provision of Chapter 6, Chapter 11, or Section 17 7-702 of the Family Financial Responsibility Law of this 18 Code, shall in addition to any other fees required by this 19 Code, pay a reinstatement fee as follows: 20 Summary suspension under Section 11-501.1.............$60 21 Other suspension......................................$30 22 Revocation............................................$60 23 (c) All fees collected under the provisions of this 24 Chapter 6 shall be paid into the Road Fund in the State 25 Treasury except as follows: 26 1. The following amounts shall be paid into the 27 Driver Education Fund: 28 (A) $16 of the $20 fee for an original 29 driver's instruction permit; 30 (B) $5 of the $10 fee for an original driver's 31 license; 32 (C) $5 of the $10 fee for a 4 year renewal 33 driver's license; and 34 (D) $4 of the $8 fee for a restricted driving SB1222 Enrolled -8- LRB9007593NTsbA 1 permit. 2 2. $30 of the $60 fee for reinstatement of a license 3 summarily suspended under Section 11-501.1 shall be 4 deposited into the Drunk and Drugged Driving Prevention 5 Fund. 6 3. $6 of such original or renewal fee for a 7 commercial driver's license and $6 of the commercial 8 driver instruction permit fee when such permit is issued 9 to any person holding a valid Illinois driver's license, 10 shall be paid into the CDLIS/AAMVAnet Trust Fund. 11 4. The $30 fee for reinstatement of a license 12 suspended under the Family Financial Responsibility Law 13 shall be paid into the Family Responsibility Fund. 14 5. The $5 fee for each original or renewal M or L 15 endorsement shall be deposited into the Cycle Rider 16 Safety Training Fund. 17 (Source: P.A. 89-92, eff. 7-1-96.) 18 Section 99. Effective date. This Act takes effect 19 January 1, 1999, except that the provisions changing Section 20 6-118 of the Illinois Vehicle Code take effect March 1, 1999.
