LRB9007303DPcw LRB9007303DPcw 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 13A-110 and adding Section 13B-48. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 13A-110 and adding Section 13B-48 as 7 follows: 8 (625 ILCS 5/13A-110) (from Ch. 95 1/2, par. 13A-110) 9 Sec. 13A-110. Special official inspection stations. 10 (a) Owners and operators of groups of vehicles which are 11 or will be subject to inspection under this Chapter, and 12 owners and operators of businesses primarily engaged in the 13 sale of new or used vehicles, may be authorized by the Agency 14 to establish and operate private official inspection stations 15 limited to the inspection and certification of their own and 16 their franchisees' vehicles, pursuant to rules and procedures 17 which shall be promulgated by the Agency. Such rules may 18 require that the operator of a private official inspection 19 station agree (1) to purchase and maintain specified 20 equipment, (2) to provide Agency personnel reasonable access 21 to the inspection equipment and premises, the relevant 22 documentation, and the inspected vehicles themselves for 23 periodic verification and assessment of inspections performed 24 at such station, and (3) to comply with such other conditions 25 as the Agency may impose. 26 (b) Official testing stations authorized to perform 27 safety tests under Chapter 13 of this Code may be authorized 28 by the Agency to operate official inspection stations limited 29 to the inspection and certification of vehicles for which 30 safety tests are required, pursuant to rules and procedures 31 which shall be promulgated by the Agency. Such rules may -2- LRB9007303DPcw 1 require that the operator of any official inspection station 2 authorized under this subsection agree (1) to purchase and 3 maintain specified equipment, (2) to provide Agency personnel 4 reasonable access to the inspection equipment, the inspection 5 premises and all relevant documentation for the periodic 6 verification and assessment of inspections performed at such 7 station, and (3) to comply with such other conditions as the 8 Agency may impose. 9 (c) The Agency may allow owners and operators of 10 businesses primarily engaged in the sale and distribution of 11 motor fuel to establish and operate private official 12 inspection stations pursuant to rules and procedures adopted 13 by the Agency. The rules and procedures may require that the 14 operator of a private official inspection station agree (1) 15 to purchase and maintain specified equipment, (2) to provide 16 Agency personnel reasonable access to the inspection 17 equipment and premises and to the relevant documentation for 18 the periodic verification and assessment of inspections 19 performed at the place of business, and (3) to comply with 20 other conditions imposed by the Agency. 21 (Source: P.A. 83-1477.) 22 (625 ILCS 5/13B-48 new) 23 Sec. 13B-48. Private official inspection stations. The 24 Agency may allow owners and operators of businesses primarily 25 engaged in the sale and distribution of motor fuel to 26 establish and operate private official inspection stations 27 pursuant to rules and procedures adopted by the Agency. The 28 rules and procedures may require that the operator of a 29 private official inspection station agree (1) to purchase and 30 maintain specified equipment, (2) to provide Agency personnel 31 reasonable access to the inspection equipment and premises 32 and to the relevant documentation for the periodic 33 verification and assessment of inspections performed at the -3- LRB9007303DPcw 1 place of business, and (3) to comply with other conditions 2 imposed by the Agency. 3 Section 99. Effective date. This Act takes effect upon 4 becoming law.
