V, Sec. 18) Proposes to amend the Executive Article of the Illinois Constitution. Eliminates the offices of the Treasurer and Comptroller. Creates the office of State Financial Officer. Provides that the State Financial Officer shall (i) maintain the State's central fiscal accounts and order payments into and out of the accounts and (ii) be responsible for the safekeeping and investment of monies and securities deposited with him or her. Effective upon voter approval as to creation of the State Financial Officer; effective beginning with the election in 2002 as to the election of a State Financial Officer; and effective upon conclusion of the terms of the Treasurer and Comptroller elected in 1998 as to the elimination of the Treasurer and the Comptroller. LRB9001446DNsb LRB9001446DNsb 1 HOUSE JOINT RESOLUTION 2 CONSTITUTIONAL AMENDMENT 3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 4 NINETIETH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 5 SENATE CONCURRING HEREIN, that there shall be submitted to 6 the electors of the State for adoption or rejection at the 7 general election next occurring at least 6 months after the 8 adoption of this resolution a proposition to amend Article V 9 of the Illinois Constitution by changing Sections 1, 3, and 10 7, by adding Section 16.5, and by repealing Sections 17 and 11 18 as follows: 12 (ILCON Art. V, Sec. 1) 13 SECTION 1. OFFICERS 14 The Executive Branch shall include a Governor, Lieutenant 15 Governor, Attorney General, Secretary of State, and State 16 Financial OfficerComptroller and Treasurerelected by the 17 electors of the State. They shall keep the public records and 18 maintain a residence at the seat of government during their 19 terms of office. 20 (Source: Illinois Constitution.) 21 (ILCON Art. V, Sec. 3) 22 SECTION 3. ELIGIBILITY 23 To be eligible to hold the office of Governor, Lieutenant 24 Governor, Attorney General, Secretary of State, or State 25 Financial OfficerComptroller or Treasurer, a person must be 26 a United States citizen, at least 25 years old, and a 27 resident of this State for the three years preceding his or 28 her election. 29 (Source: Illinois Constitution.) 30 (ILCON Art. V, Sec. 7) 31 SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES -2- LRB9001446DNsb 1 If the Attorney General, Secretary of State, or State 2 Financial OfficerComptroller or Treasurerfails to qualify 3 or if thehisoffice becomes vacant, the Governor shall fill 4 the office by appointment. The appointee shall hold office 5 until the elected officer qualifies or until a successor is 6 elected and qualified as may be provided by law and shall not 7 be subject to removal by the Governor. If the Lieutenant 8 Governor fails to qualify or if thehisoffice becomes 9 vacant, it shall remain vacant until the end of the term. 10 (Source: Illinois Constitution.) 11 SECTION 16.5. STATE FINANCIAL OFFICER - DUTIES 12 The State Financial Officer, in accordance with law, 13 shall (i) maintain the State's central fiscal accounts, and 14 order payments into and out of the accounts and (ii) shall be 15 responsible for the safekeeping and investment of monies and 16 securities deposited with him or her, and for their 17 disbursement. 18 (ILCON Art. V, Sec. 17) 19 SECTION 17. COMPTROLLER - DUTIES (REPEALED) 20The Comptroller, in accordance with law, shall maintain21the State's central fiscal accounts, and order payments into22and out of the funds held by the Treasurer.23 (Source: Illinois Constitution.) 24 (ILCON Art. V, Sec. 18) 25 SECTION 18. TREASURER - DUTIES (REPEALED) 26The Treasurer, in accordance with law, shall be27responsible for the safekeeping and investment of monies and28securities deposited with him, and for their disbursement29upon order of the Comptroller.30 (Source: Illinois Constitution.) -3- LRB9001446DNsb 1 SCHEDULE 2 This Constitutional Amendment takes effect as follows: 3 (1) those portions creating the office of State 4 Financial Officer take effect upon approval of this 5 Constitutional Amendment by the electors of this State; 6 (2) those portions providing for the election of a State 7 Financial Officer take effect beginning with the election in 8 2002; and 9 (3) those portions eliminating the offices of the 10 Treasurer and the Comptroller take effect upon the conclusion 11 of the terms of the Treasurer and Comptroller elected in 12 1998.
