          Amends the Senior Citizens and Disabled Persons  Property
      Tax  Relief  and  Pharmaceutical  Assistance  Act by making a
      technical change in the Section defining disabled person.

 1        AN ACT to amend the Senior Citizens and Disabled  Persons
 2    Property  Tax  Relief  and  Pharmaceutical  Assistance Act by
 3    changing Section 3.14.
 4        Be it enacted by the People of  the  State  of  Illinois,
 5    represented in the General Assembly:
 6        Section   5.   The  Senior  Citizens and Disabled Persons
 7    Property Tax Relief  and  Pharmaceutical  Assistance  Act  is
 8    amended by changing Section 3.14 as follows:
 9        (320 ILCS 25/3.14) (from Ch. 67 1/2, par. 403.14)
10        Sec.  3.14.  "Disabled  person"  means a person unable to
11    engage in any substantial gainful activity  by  reason  of  a
12    medically  determinable  physical  or  mental impairment that
13    which can be expected to result in death or has lasted or can
14    be expected to last for a continuous period of not less  than
15    12  months.  Disabled  persons  filing  claims under this Act
16    shall submit proof of disability in such form and  manner  as
17    the  Department shall by rule and regulation prescribe. Proof
18    that a claimant is eligible to  receive  disability  benefits
19    under  the Federal Social Security Act shall constitute proof
20    of disability for purposes  of  this  Act.   Issuance  of  an
21    Illinois Disabled Person Identification Card stating that the
22    claimant is under a Class 2 disability, as defined in Section
23    4A  of The Illinois Identification Card Act, shall constitute
24    proof that the person named thereon is a disabled person  for
25    purposes  of  this  Act.  A disabled person not covered under
26    the Federal Social Security Act and not presenting a Disabled
27    Person Identification Card stating that the claimant is under
28    a Class  2  disability  shall  be  examined  by  a  physician
29    designated  by  the  Department, and his status as a disabled
30    person determined using the same standards  as  used  by  the
31    Social  Security  Administration.  The  costs of any required

 1    examination shall be borne by the claimant.
