      305 ILCS 5/12-4.7d new
          Amends the Illinois Public Aid Code.  Provides that, as a
      condition of eligibility to participate  in  the  child  care
      assistance  program  of  the  Department  of  Human Services,
      license exempt  child  care  providers  shall  authorize  the
      Department  of  Children  and  Family Services to run a Child
      Abuse and Neglect Tracking System  (CANTS)  investigation  on
      the  provider  to  ascertain if the provider has an indicated
      report of abuse or neglect against him or her. Provides  that
      the   Departments   shall  enter  into  an  intergovernmental
      agreement to facilitate the  Department  of  Human  Services'
      requests for investigations.  Provides that the Department of
      Human  Services  shall  by  rule  determine when payment to a
      provider may be withheld if there  is  an  indicated  finding
      against the provider.  Effective immediately.

 1        AN  ACT  to  amend the Illinois Public Aid Code by adding
 2    Sections 9A-11.5 and 12-4.7d.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois Public Aid Code is amended by
 6    adding Sections 9A-11.5 and 12-4.7d as follows:
 7        (305 ILCS 5/9A-11.5 new)
 8        Sec. 9A-11.5.   Investigate  child  care  providers.  Any
 9    child  care provider who is not required to be licensed under
10    the  Child  Care  Act  of  1969  shall,  as  a  condition  of
11    eligibility to  participate  in  the  child  care  assistance
12    program  under  this  Code,  authorize  in  writing on a form
13    prescribed by the Department of Children and Family Services,
14    an investigation of the Department  of  Children  and  Family
15    Services'  Child Abuse and Neglect Tracking System (CANTS) to
16    ascertain if the child care provider has been  determined  to
17    be  a  perpetrator  in  an indicated report of child abuse or
18    neglect.
19        The Department of  Children  and  Family  Services  shall
20    conduct  an  investigation  of  the  Child  Abuse and Neglect
21    Tracking System  at  the  Request  of  the  Department.   The
22    Department  shall  request  the  Department  of  Children and
23    Family Services to conduct  an  investigation  of  the  Child
24    Abuse  and  Neglect  Tracking  System  for  each  child  care
25    provider  who  signs  an  authorization  as  provided in this
26    Section.  The Department shall by rule determine when payment
27    to a license exempt child care provider may  be  withheld  if
28    there  is  an  indicated  finding against the provider in the
29    Child Abuse and Neglect Tracking System.

 1        Sec.   12-4.7d.     Interagency    agreement    regarding
 2    investigation  of child care providers.  The Department shall
 3    enter  into  a  written  agreement  with  the  Department  of
 4    Children  and  Family  Services  which  shall   provide   for
 5    interagency  procedures  regarding requests by the Department
 6    that the Department of Children and Family  Services  conduct
 7    an  investigation  of  the  Child  Abuse and Neglect Tracking
 8    System to ascertain if a  child  care  provider  who  is  not
 9    required  to be licensed under the Child Care Act of 1969 and
10    who has signed an authorization to investigate as provided in
11    Section 9A-11.5 has been determined to be a perpetrator in an
12    indicated report of child abuse or neglect.
13        Section 99.  Effective date.  This Act takes effect  upon
14    becoming law.
