      65 ILCS 5/11-61-1         from Ch. 24, par. 11-61-1
          Amends the Illinois Municipal Code.   Provides  that  for
      the  purposes of making surveys and determining the amount of
      property necessary to be taken or damaged in connection  with
      any  highway  project,  the  municipality  may enter upon the
      lands or waters of any person or corporation, after notice to
      the owner, by certified or registered mail, 7 days before the
      entry and subject to responsibility for all damages occurring
      as a result of the entry.

 1        AN ACT to amend the Illinois Municipal Code  by  changing
 2    Section 11-61-1.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Municipal  Code  is  amended  by
 6    changing Section 11-61-1 as follows:
 7        (65 ILCS 5/11-61-1) (from Ch. 24, par. 11-61-1)
 8        Sec.   11-61-1.   The   corporate   authorities  of  each
 9    municipality may exercise the  right  of  eminent  domain  by
10    condemnation proceedings in conformity with the provisions of
11    the  constitution  and  statutes of the State of Illinois for
12    the acquirement of property useful, advantageous or desirable
13    for municipal purposes or public welfare  including  property
14    in   unincorporated   areas   outside  of  but  adjacent  and
15    contiguous to the municipality where required for  street  or
16    highway purposes by the municipality.
17        For  the  purposes  making  surveys  and  determining the
18    amount of property  necessary  to  be  taken  or  damaged  in
19    connection   with  any  highway  project,  the  municipality,
20    through its officers, agents, or employees,  may  enter  upon
21    the  lands  or  waters  of  any  person or corporation, after
22    notice to the owner, by certified or registered mail, 7  days
23    before  the  entry  and  subject  to  responsibility  for all
24    damages occurring as a result of the entry.
