 1                    AMENDMENT TO HOUSE BILL 2729
 2        AMENDMENT NO.     .  Amend House Bill 2729  by  replacing
 3    the title with the following:
 4        "AN ACT to amend the Illinois Horse Racing Act of 1975 by
 5    changing Section 21."; and
 6    by  replacing  everything  after the enacting clause with the
 7    following:
 8        "Section 5. The Illinois Horse  Racing  Act  of  1975  is
 9    amended by changing Section 21 as follows:
10        (230 ILCS 5/21) (from Ch. 8, par. 37-21)
11        Sec.  21. (a) Applications for organization licenses must
12    be filed with the Board at a time and place prescribed by the
13    rules and regulations of the Board.  The Board shall  examine
14    the  applications  within  21 days after the date allowed for
15    filing with respect to their conformity  with  this  Act  and
16    such  rules   and  regulations  as  may  be prescribed by the
17    Board.  If any application does not comply with this  Act  or
18    the  rules  and  regulations  prescribed  by  the Board, such
19    application may  be  rejected  and  an  organization  license
20    refused to the applicant, or the Board may, within 21 days of
21    the  receipt of such application, advise the applicant of the

 1    deficiencies of the application under the Act  or  the  rules
 2    and regulations of the Board, and require the submittal of an
 3    amended  application  within  a reasonable time determined by
 4    the Board; and upon submittal of the amended  application  by
 5    the   applicant,  the  Board  may  consider  the  application
 6    consistent with the process described in subsection (e-5)  of
 7    Section  20  of this Act.  If it is found to be in compliance
 8    with this Act and the rules and regulations of the Board, the
 9    Board  may  then  issue  an  organization  license  to   such
10    applicant.
11        (b)  The Board may exercise discretion in granting racing
12    dates  to qualified applicants different from those requested
13    by the applicants in their  applications.   However,  if  all
14    eligible  applicants  for  organization licenses whose tracks
15    are located within 100 miles of each other execute and submit
16    to the Board a written agreement among such applicants as  to
17    the  award of racing dates, including where applicable racing
18    programs, for up to 3  consecutive  years,  then  subject  to
19    annual review of each applicant's compliance with Board rules
20    and  regulations,  provisions  of  this  Act  and  conditions
21    contained  in  annual  dates  orders issued by the Board, the
22    Board may grant such dates and programs to such applicants as
23    so agreed by them if the Board determines that the  grant  of
24    these  racing  dates is in the best interests of racing.  The
25    Board  shall  treat  any  such  agreement  as  the  agreement
26    signatories' joint and several application for  racing  dates
27    during the term of the agreement.
28        (c)  Where  2 or more applicants propose to conduct horse
29    race meetings within 35 miles of each other, as certified  to
30    the   Board  under  Section  19  (a)  (1)  of  this  Act,  on
31    conflicting dates, the Board  may  determine  and  grant  the
32    number of racing days to be awarded to the several applicants
33    in  accordance  with  the  provisions  of subsection (e-5) of
34    Section 20 of this Act.

 1        (d)  (Blank).
 2        (e)  Prior to the issuance of  an  organization  license,
 3    the applicant shall file with the Board a bond payable to the
 4    State  of  Illinois  in  the sum of $200,000, executed by the
 5    applicant and a surety company or companies authorized to  do
 6    business  in  this State, and conditioned upon the payment by
 7    the organization licensee of all taxes due under Section  27,
 8    other  monies  due and payable under this Act, all purses due
 9    and payable, and that the  organization  licensee  will  upon
10    presentation  of the winning ticket or tickets distribute all
11    sums due to the patrons of pari-mutuel pools.
12        (f)  Each organization license shall specify  the  person
13    to  whom  it  is issued, the dates upon which horse racing is
14    permitted, and the location, place, track, or enclosure where
15    the horse race meeting is to be held.
16        (g)  Any person who owns one or more race  tracks  within
17    the  State may seek, in its own name, a separate organization
18    license for each race track.
19        (h)  All racing conducted under such organization license
20    is subject to this Act and to the rules and regulations  from
21    time  to  time  prescribed  by  the  Board,  and  every  such
22    organization  license  issued  by  the  Board shall contain a
23    recital to that effect.
24        (i)  Each Any such organization  licensee  shall  in  the
25    case  of days allotted to thoroughbred horse racing may, with
26    prior approval of the Board, provide that at least  one  race
27    per  a  day  shall  may  be  devoted to the racing of quarter
28    horses, appaloosas, or arabians, or paints.
29        (j)  In acting on applications for organization licenses,
30    the Board shall give weight to an organization license  which
31    has  implemented  a  good  faith affirmative action effort to
32    recruit, train and upgrade minorities in all  classifications
33    within the organization license.
