      625 ILCS 5/11-503         from Ch. 95 1/2, par. 11-503
          Amends the Vehicle  Code.   Provides  that  the  unlawful
      operation  of  a vehicle at a speed that is 40 miles per hour
      or more in excess of the applicable maximum  speed  is  prima
      facie evidence of reckless driving.

 1        AN  ACT  to  amend  the Illinois Vehicle Code by changing
 2    Section 11-503.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Vehicle  Code  is amended by
 6    changing Section 11-503 as follows:
 7        (625 ILCS 5/11-503) (from Ch. 95 1/2, par. 11-503)
 8        Sec.  11-503.  Reckless  driving;   aggravated   reckless
 9    driving.
10        (a)  Any  person who drives any vehicle with a willful or
11    wanton disregard for the safety of  persons  or  property  is
12    guilty  of  reckless  driving.    The unlawful operation of a
13    vehicle at a speed that is 40  miles  per  hour  or  more  in
14    excess  of  the  applicable  maximum  speed limit established
15    under  this  Chapter  or  a  similar  provision  of  a  local
16    ordinance is prima facie evidence of reckless driving.
17        (b)  Every person convicted of reckless driving shall  be
18    guilty  of  a  Class  A misdemeanor, except as provided under
19    subsection (c) of this Section.
20        (c)  Every person convicted of committing a violation  of
21    subsection (a) shall be guilty of aggravated reckless driving
22    if  the  violation  results in great bodily harm or permanent
23    disability or disfigurement to another.  Aggravated  reckless
24    driving is a Class 4 felony.
