Provides that the City shall pay the required employee
contributions for periods during which a policeman receives
an occupational disease disability benefit. Inserts
references to occupational disease disability benefits in
certain Sections relating to proof of eligibility and the
duty disability reserve. Amends the State Mandates Act to
require implementation without reimbursement. Effective
immediately.

1 AN ACT to amend the Illinois Pension Code by changing
2 Sections 5-156, 5-172, and 5-204 and to amend the State
3 Mandates Act.
4 Be it enacted by the People of the State of Illinois,
5 represented in the General Assembly:
6 Section 5. The Illinois Pension Code is amended by
7 changing Sections 5-156, 5-172, and 5-204 as follows:

9 Sec. 5-156. Proof of duty or ordinary disability -
10 Physical examinations. Proof of duty, occupational disease,
11 or ordinary disability shall be furnished to the board by at
12 least one licensed and practicing physician appointed by the
13 board. In cases where the board requests an applicant to get
14 a second opinion, the applicant must select a physician from
15 a list of qualified licensed and practicing physicians who
16 specialize in the various medical areas related to duty
17 injuries and illnesses, as established by the board. The
18 board may require other evidence of disability. A disabled
19 policeman who receives a duty, occupational disease, or
20 ordinary disability benefit shall be examined at least once a
21 year by one or more physicians appointed by the board. When
22 the disability ceases, the board shall discontinue payment of
23 the benefit, and the policeman shall be returned to active
24 service.

27 Sec. 5-172. Contributions by city for duty and
28 occupational disease disability benefits and supplemental
29 annuity. In lieu of salary deductions for annuity purposes,
30 the city shall contribute the required amounts for any period

1 during which a policeman receives a duty disability benefit
2 or occupational disease disability benefit. The
3 contributions shall be credited to the disabled policeman and
4 shall be regarded for all purposes hereof as sums deducted
5 from his salary.
6 The city shall also contribute all amounts ordinarily
7 contributed by it for annuity purposes for the policeman as
8 though he were in active discharge of his duties during such
9 disability.
10 To provide supplemental annuity, the city shall
11 contribute such equal sums annually, from the date of the
12 policeman's death, which if improved by interest will be
13 sufficient, when payment of compensation annuity ceases, to
14 provide supplemental annuity to the widow for life.

17 Sec. 5-204. Duty disability reserve. Amounts contributed
18 by the city for duty disability benefit, occupational disease
19 disability benefit, child's disability benefit, and
20 compensation annuity shall be credited to this reserve, and
21 all such benefits and annuities shall be charged to it.

23 Section 90. The State Mandates Act is amended by adding
24 Section 8.22 as follows:

26 Sec. 8.22. Exempt mandate. Notwithstanding Sections 6
27 and 8 of this Act, no reimbursement by the State is required
28 for the implementation of any mandate created by this
29 amendatory Act of 1998.
30 Section 99. Effective date. This Act takes effect upon
