90_HB1129ham001 LRB9003120SMdvam02 1 AMENDMENT TO HOUSE BILL 1129 2 AMENDMENT NO. . Amend House Bill 1129 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Illinois Public Aid Code is amended by 5 adding Section 4-20 as follows: 6 (305 ILCS 5/4-20 new) 7 Sec. 4-20. Child support income budgeting. 8 (a) Legislative findings. The General Assembly finds 9 that families receiving aid under this Article should be 10 encouraged to secure income from child support to better 11 position themselves for transition off welfare. The General 12 Assembly further finds that the current methods of budgeting 13 child support income for families receiving aid under this 14 Article is complicated and penalizes families with earnings 15 from employment who have child support collected on their 16 behalf. 17 (b) For families on cash assistance under this Article 18 who have income from employment and from child support, the 19 Department shall distribute to the family the child support 20 collected on the family's behalf which does not exceed the 21 amount required to be paid to the family for the month in 22 which it was collected and shall apply the same budgeting -2- LRB9003120SMdvam02 1 process to income from child support as it does to earned 2 income from employment under Section 4-1.6a of this Code. 3 Implementation of this budgeting process is contingent on the 4 Department's either receiving confirmation from the United 5 States Department of Health and Human Services that the 6 federal government will not claim any of the child support 7 distributed to families under this budgeting process as the 8 federal share of the amount collected or obtaining a waiver 9 from the United States Department of Health and Human 10 Services allowing use of this budgeting process and releasing 11 the federal government's claim to the federal share of the 12 amount collected. 13 (c) Families receiving assistance under this Article who 14 are entitled under federal or State law or court order to 15 have the unearned income of a household member who is not 16 included in the assistance unit earmarked or excluded from 17 consideration in the budgeting process shall have the right 18 to choose whether to have that unearned income earmarked or 19 excluded or to have it budgeted according to subsection (b). 20 Section 99. Effective date. This Act takes effect July 21 1, 1997.".
