1 AMENDMENT TO HOUSE BILL 995
2 AMENDMENT NO. . Amend House Bill 995 by replacing
3 everything after the enacting clause with following:
4 "Section 5. The Illinois Vehicle Code is amended by
5 changing Section 6-507 as follows:
6 (625 ILCS 5/6-507) (from Ch. 95 1/2, par. 6-507)
7 Sec. 6-507. Commercial Driver's License (CDL) Required.
8 (a) Except as expressly permitted by this UCDLA, or when
9 driving pursuant to the issuance of a commercial driver
10 instruction permit and accompanied by the holder of a CDL
11 valid for the vehicle being driven; no person shall drive a
12 commercial motor vehicle on the highways unless the person
13 has been issued, and is in the immediate possession of, a CDL
14 bearing all applicable endorsements valid for type or
15 classification of the commercial vehicle being driven.
16 (b) Except as otherwise provided by this Code, no person
17 may drive a commercial motor vehicle on the highways while
18 such person's driving privilege, license or permit is:
19 (1) Suspended, revoked, cancelled, or subject to
20 disqualification. Any person convicted of violating this
21 provision or a similar provision of this or any other
22 state shall have their driving privileges revoked under

1 paragraph 12 of subsection (a) of Section 6-205 of this
2 Code.
3 (2) Subject to or in violation of an
4 "out-of-service" order. Any person who has been issued a
5 CDL and is convicted of violating this provision or a
6 similar provision of any other state shall be
7 disqualified from operating a commercial motor vehicle
8 under subsection (i) of Section 6-514 of this Code.
9 (3) Subject to or in violation of an "out of
10 service" order and while transporting passengers or
11 hazardous materials. Any person who has been issued a
12 CDL and is convicted of violating this provision or a
13 similar provision of this or any other state shall be
14 disqualified from operating a commercial motor vehicle
15 under subsection (i) of Section 6-514 of this Code.
16 (c) Pursuant to the options provided to the States by
17 FHWA Docket No. MC-88-8, the driver of any motor vehicle
18 controlled or operated by or for a farmer is waived from the
19 requirements of this Section, when such motor vehicle is
20 being used to transport: agricultural products; implements
21 of husbandry; or farm supplies; as long as such movement is
22 not over 150 air miles from the originating farm. However,
23 This waiver does not apply to the driver of any truck-tractor
24 semitrailer combination(s) nor to the driver of any other
25 motor vehicle being used in a common or contract carrier type
26 operation. However, for those drivers of any truck-tractor
27 semitrailer combination or combinations, this waiver shall
28 apply only when the driver is a farmer or a member of the
29 farmer's family and the driver is 21 years of age or more and
30 has successfully completed any tests the Secretary of State
31 deems necessary.
32 In addition, the farmer or a member of the farmer's
33 family who operates a truck-tractor semitrailer combination
34 or combinations pursuant to this waiver shall be granted all

1 of the rights and shall be subject to all of the duties and
2 restrictions with respect to Sections 6-514 and 6-515 of this
3 Code applicable to the driver who possesses a commercial
4 driver's license issued under this Code, except that the
5 driver shall not be subject to any additional duties or
6 restrictions contained in Part 382 of the Federal Motor
7 Carrier Safety Regulations that are not otherwise imposed
8 under Section 6-514 or 6-515 of this Code.
9 (d) Any person convicted of violating this Section,
10 shall be guilty of a Class A misdemeanor.
11 (e) Any person convicted of violating paragraph (b) of
12 this Section, shall have all driving privileges revoked by
13 the Secretary of State.
14 (f) This Section shall not apply to:
15 (1) A person who currently holds a valid Illinois
16 driver's license, for the type of vehicle being operated,
17 until the expiration of such license or April 1, 1992,
18 whichever is earlier; or
19 (2) A non-Illinois domiciliary who is properly
20 licensed in another State, until April 1, 1992. A
21 non-Illinois domiciliary, if such domiciliary is properly
22 licensed in another State or foreign jurisdiction, until
23 April 1, 1992.

25 Section 99. Effective date. This Act takes effect upon
26 becoming law.".
