      New Act
      30 ILCS 105/5.449 new
          Creates  the  Law  Enforcement   Intern   Training   Act.
      Provides  that  the  Illinois  Law  Enforcement  Training and
      Standards  Board  shall  administer   and   conduct   a   Law
      Enforcement  Intern  Training  Program.  Establishes criteria
      for participation  in  the  program.   Provides  that  moneys
      collected or received from fees or tuition shall be deposited
      into the Police Training Board Services Fund.  Contains other
      provisions.   Amends  the  State  Finance  Act  to create the
      Police Training Board Services Fund in  the  State  Treasury.

 1        AN ACT creating the Law Enforcement Intern Training Act.
 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:
 4        Section 1.  Short title.  This Act may be  cited  as  the
 5    Law Enforcement Intern Training Act.
 6        Section 5.  Definitions.  As used in this Act:
 7        "Academy"  means  a  school certified by the Illinois Law
 8    Enforcement Training and Standards  Board  to  provide  basic
 9    training under Section 6 of the Illinois Police Training Act.
10        "Board"  means  the Illinois Law Enforcement Training and
11    Standards Board created by the Illinois Police Training Act.
12        "Law Enforcement Intern" means a civilian who has met the
13    requirements to enter the  Law  Enforcement  Intern  Training
14    Program  and who is not employed as a law enforcement officer
15    under the Illinois Police Training Act.
16        "Graduate Law Enforcement Intern" means  a  civilian  who
17    has   successfully   completed  the  law  enforcement  intern
18    training course and is not  employed  as  a  law  enforcement
19    officer under the Illinois Police Training Act.
20        "Trainee"  means a law enforcement intern who is enrolled
21    in the Law Enforcement Intern Training Program.
22        Section 10.  Initiation, administration, and  conduct  of
23    program  by  Board.  The  Board may initiate, administer, and
24    conduct the Law Enforcement  Intern  Training  Program.   The
25    training for law enforcement interns shall be provided at any
26    certified  academy  selected  by  the Board.  The Board shall
27    have the authority to establish enrollment limitations.
28        Section 15.  Election to participate in the program.  Any
29    person  may  elect  to  apply  to  participate  in  the   Law

 1    Enforcement  Intern  Training  Program.   To  be  eligible to
 2    participate,  the  person  must  meet  the  minimum  criteria
 3    established by the Board that includes, but  is  not  limited
 4    to,   physical   fitness  standards,  educational  standards,
 5    psychological standards, 21 years of age, of good  character,
 6    and  not  convicted  of  a  felony  offense  or  other  crime
 7    involving moral turpitude under the laws of this State or any
 8    other  State  that,  if  convicted  in  this  State, would be
 9    punishable as  a  felony  or  a  crime  of  moral  turpitude.
10    Applicants  shall  be accepted for the program on a person by
11    person basis and shall not take the place of or prevent a law
12    enforcement officer from entering an academy  class  to  meet
13    the  basic  training  requirements  set forth in the Illinois
14    Police Training Act.  The Board's investigators shall enforce
15    the provisions of this Act to ensure compliance with the Act,
16    including, but not  limited  to,  administrating  a  criminal
17    justice  background  check  that  includes  State and federal
18    criminal  histories,  conducting  interviews,  obtaining,  by
19    subpoena if necessary, investigative records, police records,
20    personnel records, or other records that may be needed.
21        Nothing in this Act shall override or  replace,  preempt,
22    or  supersede,  any  hiring  or  selection standard, process,
23    procedure, requirement, or mechanism established by any local
24    governmental unit, or State statute or regulation that is  in
25    effect or amended hereafter.
26        Section 20.  Certification; transition course.  The Board
27    shall  require  law  enforcement  interns  to undertake, at a
28    minimum, the same training requirements  as  established  for
29    law  enforcement  officers under the Illinois Police Training
30    Act.  The Board  certificate  reserved  for  law  enforcement
31    officers  shall  not  be  awarded  until  the law enforcement
32    intern is employed,  has  successfully  completed  the  State
33    certification exam, and meets the requirements established by

 1    the  Board.   The Law Enforcement Intern Certificate shall be
 2    issued to the trainee following the successful completion  of
 3    the  course.   The  graduate  law  enforcement intern, if not
 4    employed as a law enforcement officer within  2  years  after
 5    issuance of the law enforcement intern certificate, must then
 6    meet  the  requirements  of  the Illinois Police Training Act
 7    upon employment.  A graduate law enforcement  intern  who  is
 8    not  employed  within  one  year, but is hired within 2 years
 9    after completing the course,  must  successfully  complete  a
10    transition  course  approved  by the Illinois Police Training
11    Board and again successfully  complete  the  law  enforcement
12    State  certification  exam  in  order  to  obtain the Board's
13    certificate  reserved  for  law  enforcement  officers.   The
14    transition course shall consist of a minimum of 80 hours  and
15    shall be conducted at a Board certified academy.
16        Section  25.  Police  Training  Board Services Fund.  The
17    Board shall charge, collect, or  receive  fees,  tuition,  or
18    moneys  from  persons  electing  to enter the Law Enforcement
19    Intern Training Program equivalent to the costs of  providing
20    personnel,   equipment,   services,   and   training  to  law
21    enforcement interns that, in the judgement of the Board,  are
22    in the best interest of the State.
23        All  fees  or moneys received by the Board under this Act
24    shall be deposited in a special fund in the State Treasury to
25    be known as the Police Training  Board  Services  Fund.   The
26    moneys  deposited  in the Police Training Board Services Fund
27    shall be appropriated to the Board for expenses of the  Board
28    for the administration and conduct of training.
29        Section 30.  Rules; dismissal of trainee.  The Board  may
30    make,  amend,  and rescind any rules that may be necessary to
31    carry out the provisions of this Act.  A copy  of  all  rules
32    and  amendments  or  rescissions  shall  be  filed  with  the

 1    Secretary  of  State within a reasonable time after adoption.
 2    The academies certified by the Board and participating in the
 3    training program may dismiss from  the  academy  any  trainee
 4    prior  to  the completion of the course if, in the opinion of
 5    the person in charge of the training school, the  trainee  is
 6    unable or unwilling to satisfactorily complete the prescribed
 7    course of training.
 8        Section  35.  Severability.   The  provisions of this Act
 9    are severable under Section 1.31 of the Statute on Statutes.
10        Section 100.  The State Finance Act is amended by  adding
11    Section 5.449 as follows:

14        Section  99.  Effective date.  This Act takes effect upon
15    becoming law.
