Limits campaign contributions from State vendors to statewide executive office holders and candidates, General Assembly members and candidates, and State political committees. LRB9001891MWpc LRB9001891MWpc 1 AN ACT to amend the Election Code by adding Sections 2 9-1.9a and 9-25.5 and changing Sections 9-3, 9-4, and 9-8. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by adding 6 Sections 9-1.9a and 9-25.5 and changing Sections 9-3, 9-4, 7 and 9-8 as follows: 8 (10 ILCS 5/9-1.9a new) 9 Sec. 9-1.9a. "Principal campaign organization" means the 10 political committee designated by a candidate for statewide 11 executive office or the General Assembly, or the holder of 12 one of those offices between elections who maintains an 13 active political committee, as the committee authorized to 14 receive contributions and make expenditures in connection 15 with the nomination for election or election of that 16 candidate or office holder. When there is no political 17 committee receiving contributions or making expenditures on 18 behalf of a candidate for statewide executive office or the 19 General Assembly or for the holder of one of those offices, 20 or when the candidate or office holder has not designated a 21 political committee as his or her principal campaign 22 organization, "principal campaign organization" means the 23 candidate or office holder. A candidate for statewide 24 executive office or the General Assembly or the holder of one 25 of those offices shall not have more than one principal 26 campaign organization. 27 (10 ILCS 5/9-3) (from Ch. 46, par. 9-3) 28 Sec. 9-3. Every state political committee and every 29 local political committee shall file with the State Board of 30 Elections, and every local political committee shall file -2- LRB9001891MWpc 1 with the county clerk, a statement of organization within 30 2 days of the creation of such committee. A political 3 committee that acts as both a state political committee and a 4 local political committee shall file a copy of each statement 5 of organization with the State Board of Elections and the 6 county clerk. 7 The statement of organization shall include - 8 (a) the name and address of the political committee; 9 (b) the scope, area of activity, party affiliation, 10 candidate affiliation and his county of residence, and 11 purposes of the political committee; 12 (c) the name, address, and position of each custodian of 13 the committee's books and accounts; 14 (d) the name, address, and position of the committee's 15 principal officers, including the chairman, treasurer, and 16 officers and members of its finance committee, if any; 17 (e) a statement whether the committee is a continuing 18 one; 19 (f) a statement of what specific disposition of residual 20 fund will be made in the event of the dissolution or 21 termination of the committee; 22 (g) a listing of all banks or other financial 23 institutions, safety deposit boxes, and any other 24 repositories or custodians of funds used by the committee; 25 (h) the amount of funds available for campaign 26 expenditures as of the filing date of the committee's 27 statement of organization;.28 (i) for a political committee serving as the principal 29 campaign organization of a candidate or office holder, a 30 written statement, signed by the candidate or office holder, 31 authorizing the committee to receive contributions and make 32 expenditures in connection with the nomination for election 33 or election of the candidate or office holder. 34 (Source: P.A. 86-873.) -3- LRB9001891MWpc 1 (10 ILCS 5/9-4) (from Ch. 46, par. 9-4) 2 Sec. 9-4. I understand that the penalty 17 for willfully filing a false or incomplete statement shall be 18 a fine not to exceed $500 or imprisonment in a penal 19 institution other than the penitentiary not to exceed 6 20 months, or both fine and imprisonment." 21 ...................... ................................... 22 (date of filing) (signature of person making 23 the statement) 24 In the case of a political committee serving as the 25 principal campaign organization of a candidate or office 26 holder, the statement of organization shall also include a 27 statement by the candidate or office holder in substantially 28 the following form: 29 AUTHORIZATION OF PRINCIPAL 30 CAMPAIGN ORGANIZATION 31 I designate the committee regarding which this statement 32 is filed as the exclusive committee authorized by me to 33 receive contributions and make expenditures in connection 34 with my campaign for public office. -5- LRB9001891MWpc 1 ..................... ............................ 2 (date of filing) (signature of person 3 making this statement) 4 (Source: P.A. 86-873.) 5 (10 ILCS 5/9-8) (from Ch. 46, par. 9-8) 6 Sec. 9-8. Any political committee which solicits or 7 receives contributions or makes expenditures on behalf of any 8 candidate that is not authorized in writing by such candidate 9 to do so, or is not the principal campaign organization of 10 the candidate, shall include a notice on the face or front 11 page of all literature and advertisements published and 12 following all commercials broadcast, in connection with such 13 candidate's campaign by such committee or on its behalf 14 stating that the committee is not authorized by such 15 candidate and that such candidate is not responsible for the 16 activities of such committee. 17 (Source: P.A. 78-1183.) 18 (10 ILCS 5/9-25.5 new) 19 Sec. 9-25.5. Vendor contribution limits. 20 (a) No person who has done business with the State in 21 the preceding 4 years or is seeking to do business with the 22 State may make contributions in an aggregate amount exceeding 23 $1,500 to: 24 (1) a candidate for statewide executive office or 25 the General Assembly or a statewide executive officer or 26 General Assembly member during a single election period; 27 (2) a statewide executive officer or General 28 Assembly member during a non-election year of his or her 29 term; or 30 (3) a State political committee during a single 31 year. 32 (b) For purposes of subsection (a), a "person" includes -6- LRB9001891MWpc 1 an entity's subsidiaries, parent company, affiliated 2 companies, and their employees, officers, directors, and 3 partners who make contributions for which they are reimbursed 4 by the entity, parent company, or affiliated company. 5 "Doing business" means one or a combination of sales, 6 purchases, leases, or contracts in excess of $10,000 in 12 7 consecutive months. "Seeking to do business" means taking 8 action in the past 6 months to obtain a contract or business 9 when the action, if successful, would result in doing 10 business with the State. 11 "Election period" means, for the general primary, the 12 first day of circulation of a candidate's nominating petition 13 until the general primary and, for the general election, the 14 date of the general primary until the general election.
