1 AMENDMENT TO HOUSE BILL 207
2 AMENDMENT NO. . Amend House Bill 207 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Illinois Municipal Code is amended by
5 adding Section 11-20-3.1 as follows:
6 (65 ILCS 5/11-20-3.1 new)
7 Sec. 11-20-3.1. Regulation of tobacco vendors. The
8 corporate authorities of a municipality may provide for the
9 regulation, licensing, and inspection of any retail business
10 or establishment that is engaged in the selling of cigarettes
11 or other tobacco products. The corporate authorities of a
12 municipality shall have the power by general ordinance to
13 determine the location for the sale of cigarettes or other
14 tobacco products. However, any business or establishment
15 that has been engaged in the retail sale of cigarettes or
16 other tobacco products for the 30 days immediately preceding
17 the effective date of a licensing ordinance adopted under
18 this Section shall, upon application, be issued a license,
19 which shall be subject to all the terms and conditions of the
20 licensing ordinance, regardless of any limitation on the
21 number of licenses adopted by the corporate authorities of
22 the municipality. The municipality shall not grant a new

1 license to a business or establishment to engage in the
2 retail sale of cigarettes or other tobacco products for as
3 long as the number of outstanding licenses exceeds any
4 limitation on the number of licenses that the municipality
5 has adopted.".
