Amends the Hospital Licensing Act. Provides that in a
hospital with 100 or more patient beds, at least one
physician, in addition to any emergency room physicians,
shall be on duty at all times to serve non-emergency room
patients exclusively.

1 AN ACT to amend the Hospital Licensing Act by adding
2 Section 10.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Hospital Licensing Act is amended by
6 adding Section 10.5 as follows:
7 (210 ILCS 85/10.5 new)
8 Sec. 10.5. Mandatory non-emergency room physician. In a
9 hospital with 100 or more patient beds, at least one
10 physician, in addition to any emergency room physicians,
11 shall be on duty at all times to serve non-emergency room
12 patients exclusively. When the sole purpose of the hospital
13 is to administer therapy to patients with physical
14 disabilities and the hospital does not have an emergency
15 room, is not physically attached to another acute or subacute
16 facility, and is a teaching hospital, having a resident on
17 call is sufficient to comply with this requirement.
