WHEREAS, The members of the Illinois House of Representatives are

the State of Illinois; and
WHEREAS, It has come to our attention that Ervin R. Millsaps was
recently installed as the new Pastor at Shiloh Baptist Church in
Chicago; and
WHEREAS, Ervin R. Millsaps was licensed to preach the Gospel
Ministry at his home church, Smith Grove Baptist in Hiddenite, North
Carolina on April 23, 1980; he was ordained to the Gospel Ministry by
the Yadkin Davie Baptist Association of North Carolina on January 17,
1983; and
WHEREAS, Dr. Millsaps served as Pastor of the Old Town Baptist
Church in Galex, Virginia from 1982-1984, New Bethal Baptist Church in
Morganton, North Carolina from 1984-1988, New Hope Baptist Church in
Charlotte, North Carolina from 1988-1992, and greater Fellowship
Baptist Church in Charlotte, North Carolina from 1992-2001; and
WHEREAS, Dr. Millsaps has an extensive theological education; in
1992, he received his Bachelor of Arts degree in Religion and
Philosophy from Shaw University in Raleigh, North Carolina; in 1995,
he received a Masters of Divinity in Christian Education from
Southeastern Baptist Theological Seminary in Wake Forest, North
Carolina; a Wyatt T. Walker Fellow, he completed his post graduate
study at United Theological Seminary in Dayton, Ohio, and was awarded a
Doctor of Ministry degree in 1998; and
WHEREAS, Dr. Millsaps recognizes that the greatest challenge to the
church is to provide viable and relevant ministry to a constantly
changing and evolving community; in response to this challenge, his
Multi-Disciplinary Ministry emphasizes Biblical Literacy, Christian
Stewardship and Christian Social Activism; and
WHEREAS, Dr. Millsaps has religious affiliations with the Congress
of Christian Education, the National Baptist Convention, USA, Inc., and
The Greater New Era District Association; under the auspices of the
Congress of Christian Education, he is currently developing the Midwest
Region Discipleship Cluster; and
WHEREAS, Dr. Millsaps was born on November 12, 1961 and is a native
of Taylorville, North Carolina; he served his country in the U.S.
National Guard from 1979 to 1981; since 1982, he has been married to

graduated from the first coeducational class at Chicago Vocational High

Representative John G. Ryan and the mother of State Representative Bob

support debts more than 90 days overdue to the State to the Unit. In
the event a child support debt is referred to the Unit, the Unit must
use any appropriate means for collection of the debt that are normally
available to the Unit under State law. The debt, however, remains an
obligation owed under the Department of Public Aid's Child Support
Enforcement Program subject to the requirements of Title IV, Part D of
the federal Social Security Act, including the continued use of
federally mandated enforcement remedies and techniques by the
Department of Public Aid."; and
on page 8, line 21, after "Unit.", by inserting the following:

AMENDMENT NO. 1 TO HOUSE BILL 3642
AMENDMENT NO. 1. Amend House Bill 3642 on page 2, line 10, by
deleting "advisory"; and
on page 4, line 4, by replacing "The" with "Except as provided in
subsection (c), the"; and
on page 4, line 16, by deleting "(i)"; and
on page 4, lines 17, 18, and 19, by deleting ", (ii) whether the board
members should be elected from single-member districts, multi-member
districts, or at-large, or (iii) both"; and
on page 4, immediately below line 30, by inserting the following:
"(c) Method of election of county board. Members of the county
board may be elected from single-member districts, multi-member
districts, or at-large. The method of election of the county board may
be determined by county-wide referendum, initiated either by a petition
or by ordinance of the county board. A written petition for an advisory
referendum authorized by this subsection must contain the signatures of
at least 1% of the registered voters of the county and must be filed
with the appropriate election authority. An ordinance initiating a
referendum under this subsection must be approved by a majority of the
county board and must be filed with the appropriate election authority.
A referendum initiated under this subsection shall be placed on the
ballot at the general election designated in the petition or ordinance.
If the voters of the county alter the method of election for county
board member by referendum from an at-large election to an election by
districts, the county board shall, no later that April 1 following the
general election at which the referendum was held, develop an
apportionment plan under Section 2-3003. If the method of electing
county board members is determined by referendum, then the county board
may not alter that method by ordinance for a period of 12 years after
the date of the referendum.".
AMENDMENT NO. 2 TO HOUSE BILL 3642
AMENDMENT NO. 2. Amend House Bill 3642, AS AMENDED, by replacing
everything after the enacting clause with the following:
"Section 5. The Election Code is amended by changing Section 28-1
as follows:
(10 ILCS 5/28-1) (from Ch. 46, par. 28-1)
Sec. 28-1. The initiation and submission of all public questions
to be voted upon by the electors of the State or of any political
subdivision or district or precinct or combination of precincts shall
be subject to the provisions of this Article.
Questions of public policy which have any legal effect shall be
submitted to referendum only as authorized by a statute which so
provides or by the Constitution. Advisory questions of public policy

shall be submitted to referendum pursuant to Section 28-5 or pursuant
to a statute which so provides.
The method of initiating the submission of a public question shall
be as provided by the statute authorizing such public question, or as
provided by the Constitution.
All public questions shall be initiated, submitted and printed on
the ballot in the form required by Section 16-7 of this Act, except as
may otherwise be specified in the statute authorizing a public
question.
Whenever a statute provides for the initiation of a public question
by a petition of electors, the provisions of such statute shall govern
with respect to the number of signatures required, the qualifications
of persons entitled to sign the petition, the contents of the petition,
the officer with whom the petition must be filed, and the form of the
question to be submitted. If such statute does not specify any of the
foregoing petition requirements, the corresponding petition
requirements of Section 28-6 shall govern such petition.
Irrespective of the method of initiation, not more than 3 public
questions other than (a) back door referenda, (b) referenda to
determine whether a disconnection may take place where a city
coterminous with a township is proposing to annex territory from an
adjacent township, or (c) referenda held under the provisions of the
Property Tax Extension Limitation Law in the Property Tax Code, or (d)
advisory referenda held under Section 2-3002 of the Counties Code may
be submitted to referendum with respect to a political subdivision at
the same election.
If more than 3 propositions are timely initiated or certified for
submission at an election with respect to a political subdivision, the
first 3 validly initiated, by the filing of a petition or by the
adoption of a resolution or ordinance of a political subdivision, as
the case may be, shall be printed on the ballot and submitted at that
election. However, except as expressly authorized by law not more than
one proposition to change the form of government of a municipality
pursuant to Article VII of the Constitution may be submitted at an
election. If more than one such proposition is timely initiated or
certified for submission at an election with respect to a municipality,
the first validly initiated shall be the one printed on the ballot and
submitted at that election.
No public question shall be submitted to the voters of a political
subdivision at any regularly scheduled election at which such voters
are not scheduled to cast votes for any candidates for nomination for,
election to or retention in public office, except that if, in any
existing or proposed political subdivision in which the submission of a
public question at a regularly scheduled election is desired, the
voters of only a portion of such existing or proposed political
subdivision are not scheduled to cast votes for nomination for,
election to or retention in public office at such election, but the
voters in one or more other portions of such existing or proposed
political subdivision are scheduled to cast votes for nomination for,
election to or retention in public office at such election, the public
question shall be voted upon by all the qualified voters of the entire
existing or proposed political subdivision at the election.
Not more than 3 advisory public questions may be submitted to the
voters of the entire state at a general election. If more than 3 such
advisory propositions are initiated, the first 3 timely and validly
initiated shall be the questions printed on the ballot and submitted at
that election; provided however, that a question for a proposed
amendment to Article IV of the Constitution pursuant to Section 3,
Article XIV of the Constitution, or for a question submitted under the
Property Tax Cap Referendum Law, shall not be included in the foregoing
limitation.

Section 10. The Counties Code is amended by changing Section
2-3002 as follows:
(55 ILCS 5/2-3002) (from Ch. 34, par. 2-3002)
Sec. 2-3002. Counties with population of less than 3,000,000 and

with township form of government.
(a) Reapportionment required. By July 1, 1971, and each 10 years
thereafter, the county board of each county having a population of less
than 3,000,000 inhabitants and the township form of government shall
reapportion its county so that each member of the county board
represents the same number of inhabitants. In reapportioning its
county, the county board shall first determine the size of the county
board to be elected, which may consist of not less than 5 nor more than
29 members and may not exceed the size of the county board in that
county on October 2, 1969. The county board shall also determine
whether board members shall be elected at large from the county or by
county board districts.
If the chairman of the county board is to be elected by the voters
in a county of less than 450,000 population as provided in Section
2-3007, such chairman shall not be counted as a member of the county
board for the purpose of the limitations on the size of a county board
provided in this Section.
(b) Advisory referenda. The voters of a county may advise the
county board, through an advisory referendum, on questions concerning
(i) the number of members of the county board to be elected, (ii)
whether the board members should be elected from single-member
districts, multi-member districts, or at-large, or (iii) both. The
advisory referendum may be initiated either by petition or by ordinance
of the county board. A written petition for an advisory referendum
authorized by this Section must contain the signatures of at least 1%
of the registered voters of the county and must be filed with the
appropriate election authority. An ordinance initiating an advisory
referendum authorized by this Section must be approved by a majority of
the members of the county board and must be filed with the appropriate
election authority. An advisory referendum initiated under this
Section shall be placed on the ballot at the general election
designated in the petition or ordinance.

on page 2, in line 1 by inserting after the period the following:
"An employer with more than 100 employees shall not be required to
permit more than 3% of the employees to be absent under this Section on
the same election day.".

CONSTITUTIONAL AMENDMENT 13
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING
HEREIN, that there shall be submitted to the electors of the State for
adoption or rejection at the general election next occurring at least 6
months after the adoption of this resolution a proposition to amend
Section 2 of Article X of the Constitution as follows:
ARTICLE X
EDUCATION
(ILCON Art. X, Sec. 2)
SECTION 2. STATE BOARD OF EDUCATION - STATE SUPERINTENDENT OF EDUCATION
CHIEF STATE EDUCATIONAL OFFICER
(a) There is created a State Board of Education to be elected or
selected on a regional basis. The number of members, their
qualifications, terms of office and manner of election or selection
shall be provided by law. The Board shall advise the State
Superintendent of Education concerning, except as limited by law, may
establish goals, determine policies, provide for planning and
evaluating education programs, and recommend financing. The Board shall
have such other duties and powers as provided by law.
(b) A State Superintendent of Education shall be nominated at a
general primary election and elected by the electors of the State at
the general election every 4 years, beginning in 2006. The State
Superintendent of Education shall hold office for 4 years beginning on
the second Monday of January after his or her election. To be eligible
to hold the office of State Superintendent of Education a person must
be a United States citizen, at least 25 years old, and a resident of
the State for 10 years preceding his or her election.
The names of the candidates for State Superintendent of Education
shall be printed on the ballot directly below the names of the
candidates for Secretary of State.
Any vacancy in the office of State Superintendent of Education
shall be filled in the manner provided in Section 7 of Article V.
The State Superintendent of Education shall be the chief
educational officer of the State. The State Superintendent of
Education shall establish goals, determine policies, provide for
planning and evaluating education programs, and recommend financing.
The State Superintendent of Education shall have such other duties and
powers as provided by law. The State Board of Education shall appoint
a chief state educational officer.

SCHEDULE
A State Superintendent of Education shall be elected in 2006 and
thereafter. When the State Superintendent of Education initially
elected under Section 2 of Article X of the Illinois Constitution takes
office, the term of office of the chief state educational officer
appointed by the State Board of Education shall expire. This

Constitutional Amendment otherwise takes effect when the State
Superintendent of Education initially elected under Section 2 of
Article X of the Illinois Constitution takes office.
