HOUSE RESOLUTION 289
Offered by Representative Granberg:
WHEREAS, The members of the Illinois House of Representatives are
pleased to recognize milestone events in the history of organizations
of the State of Illinois; and
WHEREAS, It has come to our attention that the Greenville College
Choir is celebrating its 75th anniversary this year; and
WHEREAS, Robert Woods founded the Greenville College Choir in the
fall of 1927, following a concert on campus by the famous Westminister
Choir from Dayton, Ohio; after that he developed a choral organization
of outstanding reputation at Greenville College; and
WHEREAS, In the early 1930s, the Greenville College Choir began
going on extended tours and singing unaccompanied music, a pattern
established by the St. Olaf College Choirs and the Westminister Choir;
many concerts were performed in Illinois and Indiana, but later
extended across the nation from Michigan to Florida, from Ontario,
Canada to Texas; and
WHEREAS, The Greenville College Choir gained respect and wide
recognition in Chicago, Champaign-Urbana, and St. Louis, Missouri; they
sang on radio from Detroit, Chicago and Indianapolis when radio was in
its infancy; even during World War II, the choir continued to perform,
even for a period without male voices; and
WHEREAS, During Greenville College Choir's seventy-five years of
existence, only five men have served as director, and they include
Robert Woods from 1927 to 1957, James E. Wilson from 1957 through 1996,
Joe Noble from 1964 through 1965, Paul Vanderkoy from 1970 through
1972; and Dr. Jeffrey Wilson is has served as director since 1996; in
addition, Dr. Chester Alwes, has been commissioned to write a choral
composition for the choir; and
WHEREAS, Greenville College Choir is recognizing its 75th
Anniversary with four major events, that include the commissioning of a
new choral piece, the publication of a history book of the choir
including pictures and anecdotes from choir alumni, a choir alumni
reunion and concert, and a tour by the choir to England during January
2002, their first overseas tour where they will perform in concerts in
cathedrals and churches, as well as visiting many John Wesley
historical sites; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate the
Greenville College Choir on the celebration of its 75th anniversary,
and we wish it continued success for many more years to come; and be it

HOUSE RESOLUTION 290
Offered by Representative Mautino:
WHEREAS, The institution of marriage is one of the cornerstones
upon which our society is built, and a marriage that has achieved a
notable longevity is truly a model for the people of the State of
Illinois; and
WHEREAS, It has come to our attention that Mr. and Mrs. Ernest
Maunu, Jr. of Ottawa, Illinois, will celebrate the fortieth anniversary
of their marriage; and
WHEREAS, Ernest Maunu, Jr. and Helen Wolf were united in holy
matrimony on October 10, 1961 at the home of Judge L.K. Blanchard in
Washburn, Wisconsin; and
WHEREAS, They are the loving parents of Scott (wife, Patty) Maunu,
Kevin (wife, Lori) Maunu, Amy (husband, Jack) Hill, and Melissa
(husband, David) Peters; and the grandparents of twelve wonderful
grandchildren; and
WHEREAS, Ernest Maunu, Jr. is an electrician/instrumentation
technician for J.E. Merit Constructors at Akzo Nobel in Morris,
Illinois; Helen Maunu is a homemaker; and
WHEREAS, Ernest Maunu, Jr. is the son of the late Ernest and Helyn
Maunu, Sr., and Helen Maunu is the daughter of the late Roland and
Dolly Wolf, Sr.; and
WHEREAS, The respect for marriage reaches one of its highest
plateaus when a couple such as Ernest and Helen Maunu, Jr. celebrate
their fortieth wedding anniversary; and
WHEREAS, Ernest and Helen Maunu, Jr. stand as examples of the best
of our society, and their love and devotion to each other and to their
family and friends serve as a reminder to all that hard work,
dedication, and love can make a difference in today's world; therefore,

HOUSE RESOLUTION 291
Offered by Representative Persico:
WHEREAS, The members of the House of Representatives are pleased to
honor milestones in the lives of citizens of the State of Illinois; and
WHEREAS, Dr. Richard Knudsen of Glen Ellyn, Illinois will be
retiring this year after 35 years of teaching; and
WHEREAS, Dr. Knudsen has taught Technology Education (drafting,
woods, and graphic arts) at Fenton High School in Bensenville, Illinois
for the past 31 years; and
WHEREAS, Dr. Knudsen has been president and has served on the board
of directors of the Illinois Industrial Technology Association and the
Illinois Association for Career and Technical Education, he was
appointed by Governor George Ryan to sit on the HRIC/IWIB Board to
represent secondary educators, and he has been a member of the
Coalition for Quality Vocational Education; and
WHEREAS, Many schools have called on Dr. Knudsen to be an advisor,
consultant, and guest speaker to promote career and technical
education, and Dr. Knudsen has been to Washington, D.C. several times
to lobby for funds for career and technical education; and
WHEREAS, Dr. Knudsen has been recognized many times for his

accomplishments and his commitment to his students, his school, and his
profession, including being named Technology Teacher of the Year from
Illinois and Illinois Drafting Teacher of the Year, being an Illinois
Industrial Technology Education Association's Concidines recipient,
being selected for Who's Who of American Teachers 3 times, and
belonging to several honor societies; therefore be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Dr.
Richard Knudsen on his retirement after 35 years of teaching and wish

HOUSE RESOLUTION 292
Offered by Representative John Jones:
WHEREAS, The members of the Illinois House of Representatives are
honored to recognize milestone achievements in college sports in the
State of Illinois; and
WHEREAS, The Wabash Valley College Warriors Men's Basketball team
won the National Junior College Athletic Association Division I
National Championship Tournament on Saturday March 24, 2001, and
finished a superb season with a record of 36 wins and 1 loss; they are
also Great Rivers Athletic Conference, Region 4 and District 4 Champs;
and
WHEREAS, Wabash Valley College, ranked number 3 in the final
N.J.C.A.A. poll, is the first school in Illinois history to achieve
this title of N.J.C.A.A. National Champions; and
WHEREAS, Wabash Valley College defeated Allegany Community College
of Maryland, 89 to 83, in the Championship Game in Hutchinson, Kansas;
and
WHEREAS, On their way to winning the Championship, Wabash Valley
College won the opening first-round game against Barton Co. Community
College of Kansas by the score of 90 to 77; the Warriors were lead in
scoring by freshman, Antwain Barbour with 25 points, and sophomore,
Darren Tarver with 22 points; and
WHEREAS, In the Quarterfinal game, Wabash Valley College depended
on an exciting come from behind rally to tie the game as well as a
well-played over-time period to defeat Schoolcraft College of Michigan
by the score of 94 to 86; the Warriors were lead again in scoring by
freshman, Antwain Barbour with 25 points, and sophomore, Darren Tarver
with 22 points; and
WHEREAS, Wabash Valley College played number one ranked Dixie State
College of Utah in the Semifinal game; in a very competitive game,
where the two teams experienced several ties and lead changes, Wabash
Valley College prevailed the winner by the score of 76 to 73; leading
the way for the Warriors were sophomore, Darren Tarver with 21 points,
and freshman, Antwain Barbour with 19 points; and
WHEREAS, Wabash Valley College became the National Champions with a
win over Allegany by the score of 89 to 83; the leaders on the court
for the Warriors were sophomore, Darren Tarver with 23 points,
freshman, Antwain Barbour with 21 points, freshman, Omari Westley with
18 points, and Johnny Hollingsworth with 15 points; and
WHEREAS, The members of the Wabash Valley Warriors are Michael
Betts, Chaz Briggs, Hiram Fuller, John King, Darren Tarver, Antwain
Barbour, Andre Charles, Herman Davis, Kyle Foster, Andrew Harlie, C.J.
Hill, Johnny Hollingsworth, and Omari Westley; the coach is Jay
Spoonhour; the assistants are Jesse Watkins and Clyde Buck; and the
team manager is Chris Spade; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate the
Wabash Valley College Men's Basketball team on winning the National

HOUSE RESOLUTION 293
Offered by Representative Poe:
WHEREAS, The members of the Illinois House of Representatives are
pleased to recognize milestone achievements in the history of high
school organizations in the State of Illinois; and
WHEREAS, It has come to our attention that the PORTA Community
Problem Solvers Team has been selected as Illinois State Champions for
the second year in a row; and
WHEREAS, The team of talented, hard working students has put in
countless hours of public service and has successfully represented the
State of Illinois in international competition; and
WHEREAS, The PORTA Community Problem Solvers Team has also been
honored by the Illinois Emergency Management Agency, FEMA's District V
Region, and the Illinois Stormwater and Flood Plain Management
Association for their work in reclaiming and re-using flood prone land
and for educating the community in land use possibilities; and
WHEREAS, The PORTA Community Problem Solvers Team will compete with
other senior teams at the Future Problem Solving International
Competition, which will be held in June of 2001 at the University of
Georgia; the team won first place in the Civic and Cultural category at
the 2000 competition; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate the
PORTA Community Problem Solvers Team on being selected as the 2001
Illinois State Champions and we wish them well at the Future Problem
Solving International Competition this June; and be it further
RESOLVED, That a suitable copy of this resolution be presented to
the members of the PORTA Community Problem Solvers Team as an
expression of our esteem.

"(j) Except at the time of sale or repossession of the vehicle, no
person licensed as a new vehicle dealer may issue any other person a
newly created key to a vehicle unless the new vehicle dealer makes a
copy of the driver's license or State identification card of the person
requesting or obtaining the newly created key. The new vehicle dealer
must retain the copy for 30 days.
A new vehicle dealer who violates this subsection (j) is guilty of
a petty offense. Violation of this subsection (j) is not cause to
suspend, revoke, cancel, or deny renewal of the new vehicle dealer's
license."; and
on page 15, by replacing lines 7 through 26 with the following:
"(k) Except at the time of sale or repossession of the vehicle, no
person licensed as a used vehicle dealer may issue any other person a
newly created key to a vehicle unless the used vehicle dealer makes a

"Section 5. The Illinois Commercial Feed Act of 1961 is amended by
adding Section 9.5 as follows:

Sec. 9.5. Inspection of facilities processing protein derived from
mammalian tissues.
(a) As used in this Section, the terms "protein derived from
mammalian tissues" and "renderer" have the meanings given in 21 CFR
Part 589 (Substances Prohibited from Use in Animal Food or Feed).
(b) The Department shall inspect facilities of persons subject to
licensure under Section 4 of this Act that process, mix, or manufacture
any commercial feed or feed ingredient containing protein derived from
mammalian tissues, as follows:
(1) In the case of a facility operated by a renderer, at
least twice per year, and more often if the Department determines
that more frequent inspection is necessary to ensure compliance
with this Act or the requirements of federal law.
(2) In the case of a facility not operated by a renderer, at
least once per year, and more often if the Department determines
that more frequent inspection is necessary to ensure compliance
with this Act or the requirements of federal law.
At each such inspection, the Department shall inspect for any
violation of State or federal law relating to the processing, mixing,
or manufacture of commercial feed or feed ingredients containing
protein derived from mammalian tissues and may inspect for any other
violation of this Act or the rules adopted under this Act.
(c) A facility that processes, mixes, or manufactures commercial
feed or feed ingredients, but does not process, mix, or manufacture any
commercial feed or feed ingredient that contains protein derived from
mammalian tissues, is exempt from the inspection requirements of this
Section if an affidavit is submitted annually to the Department, signed
by the owner or chief operating officer of the facility, stating under
oath that the facility does not process, mix, or manufacture any
commercial feed or feed ingredient that contains protein derived from
mammalian tissues. If the affidavit is not submitted, the facility is
subject to inspection in the same manner as facilities subject to
subsection (b).
If at any time after submitting an affidavit under this subsection
a facility processes, mixes, or manufactures any commercial feed or
feed ingredient containing protein derived from mammalian tissues, the
owner or chief operating officer of the facility must so notify the
Department within 7 days, and the facility shall thereafter be subject
to the inspection requirements of subsection (b).
(d) Except as otherwise authorized or required by State or federal
law, the inspection requirements imposed by this Section terminate 3
years after the effective date of this amendatory Act of the 92nd
General Assembly.

penalties, bail balances assessed or forfeited, and any other amount

$105 $30 of the total amount collected ($5 for a traffic violation that
amounts to $55 or more and an additional fee of $100 $25 to be
collected by the Circuit Clerk for a conviction or order of supervision
for driving under the influence of alcohol or drugs), less the 2 1/2%,
within 60 days to the State Treasurer to be deposited into the Trauma
Center Fund. Of the amounts deposited into the Trauma Center Fund under
this Section, 50% shall be disbursed to the Department of Public Health
and 50% shall be disbursed to the Department of Public Aid. Not later
than March 1 of each year the Circuit Clerk shall submit a report of
the amount of funds remitted to the State Treasurer under this Section
during the preceding calendar year.

public bodies; (viii) the names, salaries, titles, and dates of
employment of all employees and officers of public bodies; (ix)
materials containing opinions concerning the rights of the state, the
public, a subdivision of state or a local government, or of any private
persons; (x) the name of every official and the final records of voting
in all proceedings of public bodies; (xi) applications for any
contract, permit, grant, or agreement except as exempted from
disclosure by subsection (g) of Section 7 of this Act; (xii) each
report, document, study, or publication prepared by independent
consultants or other independent contractors for the public body;
(xiii) all other information required by law to be made available for
public inspection or copying; (xiv) information relating to any grant
or contract made by or between a public body and another public body or
private organization; (xv) waiver documents filed with the State
Superintendent of Education or the president of the University of
Illinois under Section 30-12.5 of the School Code, concerning nominees

Section 15. The Children and Family Services Act is amended by
changing Section 5.15 as follows:
(20 ILCS 505/5.15)
Sec. 5.15. Daycare; Department of Human Services.
(a) For the purpose of ensuring effective statewide planning,
development, and utilization of resources for the day care of children,
operated under various auspices, the Department of Human Services is
designated to coordinate all day care activities for children of the
State and shall develop or continue, and shall update every year, a
State comprehensive day-care plan for submission to the Governor that
identifies high-priority areas and groups, relating them to available
resources and identifying the most effective approaches to the use of
existing day care services. The State comprehensive day-care plan shall
be made available to the General Assembly following the Governor's
approval of the plan.
The plan shall include methods and procedures for the development
of additional day care resources for children to meet the goal of
reducing short-run and long-run dependency and to provide necessary
enrichment and stimulation to the education of young children.
Recommendations shall be made for State policy on optimum use of
private and public, local, State and federal resources, including an
estimate of the resources needed for the licensing and regulation of
day care facilities.
A written report shall be submitted to the Governor and the General
Assembly annually on April 15. The report shall include an evaluation
of developments over the preceding fiscal year, including cost-benefit
analyses of various arrangements. Beginning with the report in 1990
submitted by the Department's predecessor agency and every 2 years
thereafter, the report shall also include the following:
(1) An assessment of the child care services, needs and
available resources throughout the State and an assessment of the
adequacy of existing child care services, including, but not
limited to, services assisted under this Act and under any other
program administered by other State agencies.
(2) A survey of day care facilities to determine the number
of qualified caregivers, as defined by rule, attracted to vacant

positions and any problems encountered by facilities in attracting
and retaining capable caregivers. The report shall include an
assessment, based on the survey, of improvements in employee
benefits that may attract capable caregivers.
(3) The average wages and salaries and fringe benefit
packages paid to caregivers throughout the State, computed on a
regional basis, compared to similarly qualified employees in other
but related fields.
(4) The qualifications of new caregivers hired at licensed
day care facilities during the previous 2-year period.
(5) Recommendations for increasing caregiver wages and
salaries to ensure quality care for children.
(6) Evaluation of the fee structure and income eligibility
for child care subsidized by the State.
The requirement for reporting to the General Assembly shall be
satisfied by filing copies of the report with the Speaker, the Minority
Leader, and the Clerk of the House of Representatives, the President,
the Minority Leader, and the Secretary of the Senate, and the
Legislative Research Unit, as required by Section 3.1 of the General
Assembly Organization Act, and filing such additional copies with the
State Government Report Distribution Center for the General Assembly as
is required under paragraph (t) of Section 7 of the State Library Act.
(b) The Department of Human Services shall establish policies and
procedures for developing and implementing interagency agreements with
other agencies of the State providing child care services or
reimbursement for such services. The plans shall be annually reviewed
and modified for the purpose of addressing issues of applicability and
service system barriers.
(c) In cooperation with other State agencies, the Department of
Human Services shall develop and implement, or shall continue, a
resource and referral system for the State of Illinois either within
the Department or by contract with local or regional agencies. Funding
for implementation of this system may be provided through Department
appropriations or other inter-agency funding arrangements. The resource
and referral system shall provide at least the following services:
(1) Assembling and maintaining a data base on the supply of
child care services.
(2) Providing information and referrals for parents.
(3) Coordinating the development of new child care resources.
(4) Providing technical assistance and training to child care
service providers.
(5) Recording and analyzing the demand for child care
services.
(d) The Department of Human Services shall conduct day care
planning activities with the following priorities:
(1) Development of voluntary day care resources wherever
possible, with the provision for grants-in-aid only where
demonstrated to be useful and necessary as incentives or supports.
By January 1, 2002, the Department shall design a plan to create
more child care slots as well as goals and timetables to improve
quality and accessibility of child care.
(2) Emphasis on service to children of recipients of public
assistance when such service will allow training or employment of
the parent toward achieving the goal of independence.
(3) (Blank). Maximum employment of recipients of public
assistance in day care centers and day care homes, operated in
conjunction with short-term work training programs.
(4) Care of children from families in stress and crises whose
members potentially may become, or are in danger of becoming,
non-productive and dependent.
(5) Expansion of family day care facilities wherever
possible.
(6) Location of centers in economically depressed
neighborhoods, preferably in multi-service centers with cooperation
of other agencies. The Department shall coordinate the provision of
grants, but only to the extent funds are specifically appropriated

for this purpose, to encourage the creation and expansion of child
care centers in high need communities to be issued by the State,
business, and local governments.
(7) Use of existing facilities free of charge or for
reasonable rental whenever possible in lieu of construction.
(8) Development of strategies for assuring a more complete
range of day care options, including provision of day care services
in homes, in schools, or in centers, which will enable a parent or
parents to complete a course of education or obtain or maintain
employment and the creation of more child care options for swing
shift, evening, and weekend workers and for working women with sick
children. The Department shall encourage companies to provide
child care in their own offices or in the building in which the
corporation is located so that employees of all the building's
tenants can benefit from the facility.
(9) Development of strategies for subsidizing students
pursuing degrees in the child care field.
(10) Continuation and expansion of service programs that
assist teen parents to continue and complete their education.
Emphasis shall be given to support services that will help to
ensure such parents' graduation from high school and to services for
participants in any programs the Project Chance program of job training
conducted by the Department.
(e) The Department of Human Services shall actively stimulate the
development of public and private resources at the local level. It
shall also seek the fullest utilization of federal funds directly or
indirectly available to the Department.
Where appropriate, existing non-governmental agencies or
associations shall be involved in planning by the Department.
(f) To better accommodate the child care needs of low income
working families, especially those who receive Temporary Assistance for
Needy Families (TANF) or who are transitioning from TANF to work, or
who are at risk of depending on TANF in the absence of child care, the
Department shall complete a study using outcome-based assessment
measurements to analyze the various types of child care needs,
including but not limited to: child care homes; child care facilities;
before and after school care; and evening and weekend care. Based upon
the findings of the study, the Department shall develop a plan by April
15, 1998, that identifies the various types of child care needs within
various geographic locations. The plan shall include, but not be
limited to, the special needs of parents and guardians in need of
non-traditional child care services such as early mornings, evenings,
and weekends; the needs of very low income families and children and
how they might be better served; and strategies to assist child care
providers to meet the needs and schedules of low income families.

Section 20. The Child Death Review Team Act is amended by changing
Sections 10, 15, 30, and 35 and by adding Section 40 as follows:

"Child" means any person under the age of 18 years unless legally
emancipated by reason of marriage or entry into a branch of the United
States armed services.
"Department" means the Department of Children and Family Services.
"Director" means the Director of Children and Family Services.
"Executive Council" means the Illinois Child Death Review Teams
Executive Council.

Sec. 15. Child death review teams; establishment.
(a) The Director, in consultation with the Executive Council, law
enforcement, and other professionals who work in the field of
investigating, treating, or preventing child abuse or neglect in that
subregion, shall appoint members to a child death review team in each

of the Department's administrative subregions of the State outside Cook
County and at least one child death review team in Cook County. The
members of a team shall be appointed for 2-year terms and shall be
eligible for reappointment upon the expiration of the terms.
(b) Each child death review team shall consist of at least one
member from each of the following categories:
(1) Pediatrician or other physician knowledgeable about child
abuse and neglect.
(2) Representative of the Department.
(3) State's attorney or State's attorney's representative.
(4) Representative of a local law enforcement agency.
(5) Psychologist or psychiatrist.
(6) Representative of a local health department.
(7) Representative of a school district or other education or
child care interests.
(8) Coroner or forensic pathologist.
(9) Representative of a child welfare agency or child
advocacy organization.
(10) Representative of a local hospital, trauma center, or
provider of emergency medical services.
Each child death review team may make recommendations to the
Director concerning additional appointments.
Each child death review team member must have demonstrated
experience and an interest in investigating, treating, or preventing
child abuse or neglect.
(c) Each child death review team shall select a chairperson from
among its members. The chairperson shall also serve on the Illinois
Child Death Review Teams Executive Council.

Sec. 30. Public access to information.
(a) Meetings of the child death review teams and the Executive
Council shall be closed to the public. Meetings of the child death
review teams and the Executive Council are not subject to the Open
Meetings Act (5 ILCS 120/1 et seq.), as provided in that Act.
(b) Records and information provided to a child death review team
and the Executive Council, and records maintained by a team or the
Executive Council, are confidential and not subject to the Freedom of
Information Act (5 ILCS 140/1 et seq.), as provided in that Act.
Nothing contained in this subsection (b) prevents the sharing or
disclosure of records, other than those produced by a Child Death
Review Team or the Executive Council, relating or pertaining to the
death of a minor under the care of or receiving services from the
Department of Children and Family Services and under the jurisdiction
of the juvenile court with the juvenile court, the State's Attorney,
and the minor's attorney.
(c) Members of a child death review team and the Executive Council
are not subject to examination, in any civil or criminal proceeding,
concerning information presented to members of the team or the
Executive Council or opinions formed by members of the team or the
Executive Council based on that information. A person may, however, be
examined concerning information provided to a child death review team
or the Executive Council that is otherwise available to the public.
(d) Records and information produced by a child death review team
and the Executive Council are not subject to discovery or subpoena and
are not admissible as evidence in any civil or criminal proceeding.
Those records and information are, however, subject to discovery or a
subpoena, and are admissible as evidence, to the extent they are
otherwise available to the public.

Sec. 35. Indemnification. The State shall indemnify and hold
harmless members of a child death review team and the Executive Council
for all their acts, omissions, decisions, or other conduct arising out
of the scope of their service on the team or Executive Council, except

(a) The Illinois Child Death Review Teams Executive Council,
consisting of the chairpersons of the 9 child death review teams in
Illinois, is the coordinating and oversight body for child death review
teams and activities in Illinois. The vice-chairperson of a child death
review team, as designated by the chairperson, may serve as a back-up
member or an alternate member of the Executive Council, if the
chairperson of the child death review team is unavailable to serve on
the Executive Council. The Inspector General of the Department, ex
officio, is a non-voting member of the Executive Council. The Director
may appoint to the Executive Council any ex-officio members deemed
necessary. Persons with expertise needed by the Executive Council may
be invited to meetings. The Executive Council must select from its
members a chairperson and a vice-chairperson, each to serve a 2-year,
renewable term.
The Executive Council must meet at least 4 times during each
calendar year.
(b) The Department must provide or arrange for the staff support
necessary for the Executive Council to carry out its duties. The
Director, in cooperation and consultation with the Executive Council,
shall appoint, reappoint, and remove team members.
(c) The Executive Council has, but is not limited to, the
following duties:
(1) To serve as the voice of child death review teams in
Illinois.
(2) To oversee the regional teams in order to ensure that the
teams' work is coordinated and in compliance with the statutes and
the operating protocol.
(3) To ensure that the data, results, findings, and
recommendations of the teams are adequately used to make any
necessary changes in the policies, procedures, and statutes in
order to protect children in a timely manner.
(4) To collaborate with the General Assembly, the Department,
and others in order to develop any legislation needed to prevent
child fatalities and to protect children.
(5) To assist in the development of quarterly and annual
reports based on the work and the findings of the teams.
(6) To ensure that the regional teams' review processes are
standardized in order to convey data, findings, and recommendations
in a usable format.
(7) To serve as a link with child death review teams
throughout the country and to participate in national child death
review team activities.
(8) To develop an annual statewide symposium to update the
knowledge and skills of child death review team members and to
promote the exchange of information between teams.
(9) To provide the child death review teams with the most
current information and practices concerning child death review and
related topics.
(10) To perform any other functions necessary to enhance the
capability of the child death review teams to reduce and prevent
child injuries and fatalities.
(d) In any instance when a child death review team does not
operate in accordance with established protocol, the Director, in
consultation and cooperation with the Executive Council, must take any
necessary actions to bring the team into compliance with the protocol.
Section 25. The Department of State Police Law of the Civil
Administrative Code of Illinois is amended by adding Section 2605-480
as follows:

Sec. 2605-480. Statewide kidnapping alert program. The Department
of State Police shall develop a coordinated program for a statewide

emergency alert system when a child is missing or kidnapped.
Section 95. No acceleration or delay. Where this Act makes
changes in a statute that is represented in this Act by text that is
not yet or no longer in effect (for example, a Section represented by
multiple versions), the use of that text does not accelerate or delay
the taking effect of (i) the changes made by this Act or (ii)
provisions derived from any other Public Act.
Section 99. Effective date. This Act takes effect upon becoming
law.".

Sec. 12-603.1. Driver and passenger required to use safety belts,
exceptions and penalty.
(a) Each driver and front seat passenger of a motor vehicle
operated on a street or highway in this State shall wear a properly
adjusted and fastened seat safety belt; except that, a child less than
6 years of age shall be protected as required pursuant to the Child
Passenger Protection Act. Each driver under the age of 18 years and
each of the driver's passengers under the age of 18 years of a motor
vehicle operated on a street or highway in this State shall wear a
properly adjusted and fastened seat safety belt. Each driver of a motor
vehicle transporting a child 6 years of age or more, but less than 16
years of age, in the front seat of the motor vehicle shall secure the
child in a properly adjusted and fastened seat safety belt.
(b) Paragraph (a) shall not apply to any of the following:
1. A driver or passenger frequently stopping and leaving the
vehicle or delivering property from the vehicle, if the speed of
the vehicle between stops does not exceed 15 miles per hour.
2. A driver or passenger possessing a written statement from
a physician that such person is unable, for medical or physical
reasons, to wear a seat safety belt.
3. A driver or passenger possessing an official certificate
or license endorsement issued by the appropriate agency in another
state or country indicating that the driver is unable for medical,
physical, or other valid reasons to wear a seat safety belt.
4. A driver operating a motor vehicle in reverse.
5. A motor vehicle with a model year prior to 1965.
6. A motorcycle or motor driven cycle.
7. A motorized pedalcycle.
8. A motor vehicle which is not required to be equipped with
seat safety belts under federal law.
9. A motor vehicle operated by a rural letter carrier of the
United States postal service while performing duties as a rural
letter carrier.
(c) Failure to wear a seat safety belt in violation of this
Section shall not be considered evidence of negligence, shall not limit
the liability of an insurer, and shall not diminish any recovery for
damages arising out of the ownership, maintenance, or operation of a
motor vehicle.
(d) A violation of this Section shall be a petty offense and
subject to a fine not to exceed $25.
(e) (Blank) No motor vehicle, or driver or passenger of such
vehicle, shall be stopped or searched by any law enforcement officer
solely on the basis of a violation or suspected violation of this
Section.
(f) A law enforcement officer may not search or inspect a motor
vehicle, its contents, the driver, or a passenger solely because of a
violation of this Section.

Section 10. The Code of Criminal Procedure of 1963 is amended by

(d) Discovering any instruments, articles, or things which may
have been used in the commission of, or which may constitute evidence

solely on the basis of a violation or suspected violation of Section

"Section 1. Short title. This Act may be cited as the Prizes and
Gifts Act.
Section 5. Legislative intent. The General Assembly finds that
deceptive promotional advertising of prizes is a matter vitally
affecting the public interest in this State.
Section 10. Definitions. As used in this Act:
"Catalog seller" means an entity (and its subsidiaries) or a person
at least 50% of whose annual revenues are derived from the sale of
products sold in connection with the distribution of catalogs of at
least 24 pages, which contain written descriptions or illustrations and
sale prices for each item of merchandise and which are distributed in
more than one state with a total annual distribution of at least
250,000.
"Person" means a corporation, partnership, limited liability
company, sole proprietorship, or natural person.
"Prize" means a gift, award, or other item or service of value that
is offered or awarded to a participant in a real or purported contest,
competition, sweepstakes, scheme, plan, or other selection process that
involves an element of chance.
"Retail value" of a prize means:
(1) a price at which the sponsor can substantiate that a
substantial quantity of the item or service offered as a prize has
been sold to the public; or
(2) if the sponsor is unable to satisfy the requirement in
subdivision (1), no more than 3 times the amount the sponsor paid
for the prize in a bona fide purchase from an unaffiliated seller.
"Sponsor" means a person on whose behalf a promotion is conducted
to promote or advertise goods, services, or property of that person.
"Sponsor" includes a person who conducts a promotion on behalf of
another sponsor.
Section 15. Application of Act. Except as otherwise provided in
this Act, this Act applies only to a written promotional offer that is:
(1) made to a person in this State;
(2) used to induce or invite a person to come to this State
to claim a prize, attend a sales presentation, meet a promoter,
sponsor, salesperson, or agent, or conduct any business in this
State; or
(3) used to induce or invite a person to contact by any means
a promoter, sponsor, salesperson, or agent in this State.

Section 20. No payment required.
(a) No sponsor may require a person in this State to pay the
sponsor money as a condition of awarding the person a prize, or as a
condition of allowing the person to receive, use, compete for, or
obtain information about a prize.
(b) A sponsor shall not represent that a person has won or
unconditionally will be the winner of a prize or use language that may
lead a person to believe he or she has won a prize, unless all of the
following conditions are met:
(1) the person is given the prize without obligation;
(2) the person is notified at no expense to him or her within
15 days of winning the prize; and
(3) the representation is not false, deceptive, or
misleading.
Section 25. Disclosures required. A written promotional prize
offer must contain each of the following in a clear and conspicuous
statement at the onset of the offer:
(1) the true name or names of the sponsor and the address of
the sponsor's actual principal place of business;
(2) the retail value of each prize the person receiving the
notice has been selected to receive or may be eligible to receive;
(3) a disclosure that no purchase is necessary to enter such
written promotional offer;
(4) a disclosure that a purchase will not improve the
person's chances of winning with an entry;
(5) a statement of the person's odds of receiving each prize
identified in the notice;
(6) any requirement that the person pay the actual shipping
or handling fees or any other charges to obtain or use a prize,
including the nature and amount of the charges;
(7) if receipt of the prize is subject to a restriction, a
description of the restriction;
(8) any limitations on eligibility; and
(9) if a sponsor represents that the person is a "finalist",
has been "specially selected", is in "first place", or is otherwise
among a limited group of persons with an enhanced likelihood of
receiving a prize, the written prize notice must contain a
statement of the maximum number of persons in the group or
purported group with this enhanced likelihood of receiving a prize.
Section 30. Prize award required. A sponsor who represents that a
person has been awarded a prize shall, not later than 30 days after
making the representation, provide the person with:
(1) the prize;
(2) a voucher, certificate, or other document giving the
person the prize; or
(3) the retail value of the prize, as stated in the written
prize notice, in the form of cash, a money order, or a certified
check.
Section 32. Advertising media exempt. Nothing in this Act creates
liability for acts by the publisher, owner, agent, or employee of a
newspaper, periodical, radio station, television station, cable
television system, or other advertising medium arising out of the
publication or dissemination of a solicitation, notice, or promotion
governed by this Section unless the publisher, owner agent, or employee
had knowledge that the solicitation, notice, or promotion violated the
requirements of this Section, or had a financial interest in the
solicitation, notice, or promotion.
Section 35. Exemptions. This Act does not apply to solicitations
or representations in connection with:
(1) the sale or purchase of books, recordings, video
cassettes, periodicals, and similar goods through a membership
group or club that is regulated by the Federal Trade Commission
under Code of Federal Regulations, Title 16, part 425.1, concerning
the use of negative option plans by sellers in commerce;
(2) the sale or purchase of goods ordered through a
contractual plan or arrangement such as a continuity plan,

subscription arrangement, or a single sale or purchase series
arrangement under which the seller ships goods to a consumer who
has consented in advance to receive the goods and after the receipt
of the goods is given the opportunity to examine the goods and to
receive a full refund of charges for the goods upon return of the
goods in an undamaged condition;
(3) sales by a catalog seller;
(4) the State lottery created and regulated under the
Illinois Lottery Law;
(5) the sale or purchase of membership camping contracts in
accordance with the Illinois Membership Campground Act; or
(6) the sale or purchase of time-shares created and regulated
under the Illinois Real Estate Time-Share Act.
Section 40. Violations.
(a) Nothing in this Act may be construed to permit an activity
otherwise prohibited by law.
(b) Enforcement by consumer. A consumer who suffers loss by
reason of any intentional violation of any provision of this Act may
bring a civil action to enforce that provision. A consumer who is
successful in such an action shall recover the greater of $500 or twice
the amount of the pecuniary loss, reasonable attorney's fees, and court
costs incurred by bringing such action.
(c) Enforcement by Attorney General or State's Attorney.
Violation of any of the provisions of this Act is an unlawful practice
under the Consumer Fraud and Deceptive Business Practices Act. All
remedies, penalties, and authority granted to the Attorney General or
State's Attorney by that Act shall be available to him or her for the
enforcement of this Act.
Section 90. Severability. If any provision of this Act or the
application thereof to any person or circumstance is held invalid, the
invalidity shall not affect other provisions or applications of the Act
which can be given effect without the invalid provision or application
and to this end the provisions of this Act are severable.".

Sec. 20. Eligibility.
(a) To be eligible for this Program, a person must be a person who
has a child eligible under this Act and who is eligible under a waiver
of federal requirements pursuant to an application made pursuant to
subdivision (a)(1) of Section 40 of this Act or who is a child who
meets the following criteria:
(1) Is a child who is not eligible for medical assistance.;
(2) Is a child whose annual household income, as determined
by the Department, is above 133% of the federal poverty level and
at or below 185% of the federal poverty level. In making a
determination of income eligibility under this paragraph (2), the
Department shall accept an applicant's attestation that a child
satisfies the household income requirement of this paragraph. The
attestation is subject to verification by the Department after the
child's enrollment in the program if the child meets all other
applicable eligibility requirements. In verifying income
eligibility under this paragraph, the Department may, within an
appropriate period of time, use any reasonable means to verify a
child's household income. The Department may not determine that a
child's household income is unverifiable for the sole reason that
the applicant is unable to provide pay stubs or other statements of
income from an employer or other person.;
(3) Is a resident of the State of Illinois.; and
(4) Is a child who is either a United States citizen or
included in one of the following categories of non-citizens:
(A) unmarried dependent children of either a United
States Veteran honorably discharged or a person on active
military duty;
(B) refugees under Section 207 of the Immigration and
Nationality Act;
(C) asylees under Section 208 of the Immigration and
Nationality Act;
(D) persons for whom deportation has been withheld under
Section 243(h) of the Immigration and Nationality Act;
(E) persons granted conditional entry under Section
203(a)(7) of the Immigration and Nationality Act as in effect
prior to April 1, 1980;
(F) persons lawfully admitted for permanent residence
under the Immigration and Nationality Act; and
(G) parolees, for at least one year, under Section
212(d)(5) of the Immigration and Nationality Act.
Those children who are in the categories set forth in subdivisions
(4)(F) and (4)(G) of this subsection, who enter the United States on or
after August 22, 1996, shall not be eligible for 5 years beginning on
the date the child entered the United States.
(b) A child who is determined to be eligible for assistance shall
remain eligible for 12 months, provided the child maintains his or her
residence in the State, has not yet attained 19 years of age, and is
not excluded pursuant to subsection (c). Eligibility shall be

re-determined by the Department at least annually.
(c) A child shall not be eligible for coverage under this Program
if:
(1) the premium required pursuant to Section 30 of this Act
has not been paid. If the required premiums are not paid the
liability of the Program shall be limited to benefits incurred
under the Program for the time period for which premiums had been
paid. If the required monthly premium is not paid, the child shall
be ineligible for re-enrollment for a minimum period of 3 months.
Re-enrollment shall be completed prior to the next covered medical
visit and the first month's required premium shall be paid in
advance of the next covered medical visit. The Department shall
promulgate rules regarding grace periods, notice requirements, and
hearing procedures pursuant to this subsection;
(2) the child is an inmate of a public institution or a
patient in an institution for mental diseases; or
(3) the child is a member of a family that is eligible for
health benefits covered under the State of Illinois health benefits
plan on the basis of a member's employment with a public agency.

submit information needed to determine eligibility for these programs
more than once.

AMENDMENT NO. 2 TO SENATE BILL 885
AMENDMENT NO. 2. Amend Senate Bill 885, AS AMENDED, by replacing
everything after the enacting clause with the following:
"Section 5. The Children's Health Insurance Program Act is amended
by changing Sections 25 and 40 as follows:
(215 ILCS 106/25)
(Section scheduled to be repealed on July 1, 2002)
Sec. 25. Health benefits for children.
(a) The Department shall, subject to appropriation, provide health
benefits coverage to eligible children by:
(1) Subsidizing the cost of privately sponsored health
insurance, including employer based health insurance, to assist
families to take advantage of available privately sponsored health
insurance for their eligible children; and
(2) Purchasing or providing health care benefits for eligible
children. The health benefits provided under this subdivision
(a)(2) shall, subject to appropriation and without regard to any
applicable cost sharing under Section 30, be identical to the
benefits provided for children under the State's approved plan
under Title XIX of the Social Security Act. Providers under this
subdivision (a)(2) shall be subject to approval by the Department
to provide health care under the Illinois Public Aid Code and shall
be reimbursed at the same rate as providers under the State's
approved plan under Title XIX of the Social Security Act. In
addition, providers may retain co-payments when determined
appropriate by the Department.
(b) The subsidization provided pursuant to subdivision (a)(1)
shall be credited to the family of the eligible child. The Department
shall make the subsidization pursuant to subdivision (a)(1) available
to children whose annual household income is at or below 133% of the
federal poverty level.
(c) The Department is prohibited from denying coverage to a child
who is enrolled in a privately sponsored health insurance plan pursuant
to subdivision (a)(1) because the plan does not meet federal
benchmarking standards or cost sharing and contribution requirements.
To be eligible for inclusion in the Program, the plan shall contain
comprehensive major medical coverage which shall consist of physician
and hospital inpatient services. The Department is prohibited from
denying coverage to a child who is enrolled in a privately sponsored
health insurance plan pursuant to subdivision (a)(1) because the plan
offers benefits in addition to physician and hospital inpatient
services.
(d) The total dollar amount of subsidizing coverage per child per
month pursuant to subdivision (a)(1) shall be equal to the average
dollar payments, less premiums incurred, per child per month pursuant
to subdivision (a)(2). The Department shall set this amount
prospectively based upon the prior fiscal year's experience adjusted
for incurred but not reported claims and estimated increases or
decreases in the cost of medical care. Payments obligated before July
1, 1999, will be computed using State Fiscal Year 1996 payments for
children eligible for Medical Assistance and income assistance under
the Aid to Families with Dependent Children Program, with appropriate
adjustments for cost and utilization changes through January 1, 1999.
The Department is prohibited from providing a subsidy pursuant to
subdivision (a)(1) that is more than the individual's monthly portion
of the premium.
(e) An eligible child may obtain immediate coverage under this
Program only once during a medical visit. If coverage lapses,
re-enrollment shall be completed in advance of the next covered medical
visit and the first month's required premium shall be paid in advance
of any covered medical visit.
(f) In order to accelerate and facilitate the development of
networks to deliver services to children in areas outside counties with

populations in excess of 3,000,000, in the event less than 25% of the
eligible children in a county or contiguous counties has enrolled with
a Health Maintenance Organization pursuant to Section 5-11 of the
Illinois Public Aid Code, the Department may develop and implement
demonstration projects to create alternative networks designed to
enhance enrollment and participation in the program. The Department
shall prescribe by rule the criteria, standards, and procedures for
effecting demonstration projects under this Section.

Sec. 40. Waivers.
(a) The Department shall request any necessary waivers of federal
requirements in order to allow receipt of federal funding for:
(1) the coverage of families with eligible children under
this Act; and
(2) for the coverage of children who would otherwise be
eligible under this Act, but who have health insurance; and.
(3) the coverage of children that are eligible under
subsection (b) of Section 25.
(b) The failure of the responsible federal agency to approve a
waiver for children who would otherwise be eligible under this Act but
who have health insurance shall not prevent the implementation of any
Section of this Act provided that there are sufficient appropriated
funds.

WHEREAS, Child support collection, disbursement, and enforcement
duties were transferred to the Department of Public Aid, and in October
1999 the State Disbursement Unit assumed disbursement duties; and
WHEREAS, Due to the lack of an independent centralized agency whose
sole purpose is the establishment, enforcement, and disbursement of
child support in a timely and efficient manner, numerous complaints and
problems have arisen regarding the timeliness and accuracy of
collections and disbursements; and
WHEREAS, Child support is a necessary component in the finances of
a rising number of households in the State of Illinois, and the lack of
support forces custodial parents to apply for or remain on public
assistance; and
WHEREAS, Child support requires the complete attention and focus of
the agency charged with child support establishment, collection,
disbursement, and enforcement, because the Department of Public Aid is
also responsible for programs including KidCare and Medicaid;
therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the House Task Force on
Child Support Collection and Enforcement is created, to consist of 10
members, appointed 5 each by the Speaker of the House of
Representatives and the Minority Leader of the House of

RESOLVED, That the task force shall explore, via hearings any other
reasonable methods conducted during the summer of 2001, the possibility
of creating an independent agency for the collection and enforcement of

HOUSE JOINT RESOLUTION 35
Offered by Representative Hannig:
WHEREAS, In 1980, the General Assembly authorized the Teachers'
Retirement System of the State of Illinois (TRS) to establish a health
insurance program for benefit recipients and their dependents, with
annuitants paying 50% of the cost; and
WHEREAS, In 1991, the General Assembly authorized TRS to increase
the subsidy from 50% to 75% to achieve closer parity with State
retirees' health insurance premiums; and
WHEREAS, In 1995, the General Assembly transferred the health
insurance program from TRS to the State of Illinois, to be administered
by the Department of Central Management Services (CMS), and established
the Teachers' Retirement Insurance Program (TRIP); and
WHEREAS, The General Assembly reduced the premium subsidy for the
traditional indemnity plan from 75% to 50%; and
WHEREAS, The General Assembly mandated that active teachers pay
0.50% of their salary to help finance the CMS program; and
WHEREAS, The General Assembly mandated the State of Illinois to
match the contributions of the active teachers to help finance the CMS
program; and
WHEREAS, The Illinois Economic and Fiscal Commission reported in
November of 2000 that current revenues would not be able to fund the
current TRIP, with a shortfall of $9.3 million by the end of fiscal
year 2002; and
WHEREAS, The Illinois Economic and Fiscal Commission updated its
report in April of 2001, increasing the shortfall to $37.6 million by
the end of fiscal year 2002; and
WHEREAS, TRS has hired a health insurance actuary to provide an
independent review of the current TRIP funding status and an analysis
of TRIP's projected financial needs, along with possible alternative
scenarios; and
WHEREAS, The Illinois Economic and Fiscal Commission identified 4
possible funding sources for increasing TRIP funding: retiree premiums,
active teacher contributions, State contributions, and a new
contribution requirement for school districts; and
WHEREAS, CMS has proposed an increase to 70% for annuitant and
dependent premiums; therefore be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING
HEREIN, that the Governor reduce the 70% proposal by the Department of
Central Management Services to a level similar to previous years'
increases; and be it further
RESOLVED, That a TRIP Funding Task Force be established, composed
of 2 members appointed by the President of the Senate, 2 members
appointed by the Minority Leader of the Senate, 2 members appointed by
the Speaker of the House, 2 members appointed by the Minority Leader of
the House, one member appointed by the Illinois Retired Teachers
Association, one member appointed by the Illinois Education
Association, one member appointed by the Illinois Federation of
Teachers, and 2 members appointed by the Illinois Statewide School
Management Alliance, to study the current funding shortfall and to
report its recommendations on a solution to the General Assembly on or
before November 1, 2001; and be it further
RESOLVED, That suitable copies of this resolution be delivered to
the Governor, the Illinois Retired Teachers Association, the Illinois
Education Association, the Illinois Federation of Teachers, and the
Illinois Statewide School Management Alliance.
