AMENDMENT TO SENATE BILL 740




2    AMENDMENT NO. ______. Amend Senate Bill 740 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Fire Hydrant Act is amended  by adding 
5Section 2 as follows:
 
6    (425 ILCS 20/2 new)
7    Sec. 2. Recovery of costs; fire hydrant.
8    (a) As used in this Section, "fire hydrant" means a water 
9hydrant connected to a water supply system installed for the 
10express purpose of providing water for fire suppression and 
11that a fire department can connect to and from which it can 
12pump or draw water. "Fire hydrant" does not include flush 
13hydrants. 
14    (b) Whoever fails to comply with any of the provisions of 
15this Act within 30 days after written notice of noncompliance 
16or violation should reasonably have been received from a fire

1protection district, township fire department, or municipality 
2in whose jurisdiction a fire hydrant is located, shall be 
3responsible for all reasonable costs that the fire protection 
4district, township fire department, or municipality incurs to 
5correct the noncompliance, including attorney's fees and legal 
6expenses incurred by the fire protection district, township 
7fire department, or municipality in recovering the costs from 
8the responsible party.
 
 
9    Section 99. Effective date. This Act takes effect upon 
10becoming law.".
