1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Identification Card Act is amended | |||||||||||||||||||
5 | by changing Section 5 as follows: | |||||||||||||||||||

7 | Sec. 5. Applications. | |||||||||||||||||||
8 | (a) Any natural person who is a resident of the
State of | |||||||||||||||||||
9 | Illinois may file an application for an identification card, or | |||||||||||||||||||
10 | for
the renewal thereof, in a manner prescribed by the | |||||||||||||||||||
11 | Secretary. Each original application
shall be completed by the | |||||||||||||||||||
12 | applicant in full and shall set forth the legal
name,
residence | |||||||||||||||||||
13 | address and zip code, social security number, birth date, sex | |||||||||||||||||||
14 | and
a brief
description of the applicant. If the applicant is a | |||||||||||||||||||
15 | person enrolled in a public or private high school in this | |||||||||||||||||||
16 | State, then the applicant shall only be required to submit | |||||||||||||||||||
17 | proof of enrollment and a current identification card issued by | |||||||||||||||||||
18 | the high school. Upon request by the Secretary, the high school | |||||||||||||||||||
19 | evidenced in the proof of enrollment shall then verify and | |||||||||||||||||||
20 | submit the information required under this subsection (a) to | |||||||||||||||||||
21 | the Secretary for purposes of the identification card | |||||||||||||||||||
22 | application. The applicant shall be photographed, unless the | |||||||||||||||||||
23 | Secretary of State has provided by rule for the issuance of |

1 | identification cards without photographs and the applicant is | ||||||
2 | deemed eligible for an identification card without a photograph | ||||||
3 | under the terms and conditions imposed by the Secretary of | ||||||
4 | State, and he
or she shall also submit any other information as | ||||||
5 | the Secretary may deem necessary
or such documentation as the | ||||||
6 | Secretary may require to determine the
identity of the | ||||||
7 | applicant. In addition to the residence address, the Secretary | ||||||
8 | may allow the applicant to provide a mailing address. If the | ||||||
9 | applicant is a judicial officer as defined in Section 1-10 of | ||||||
10 | the Judicial Privacy Act or a peace officer, the applicant may | ||||||
11 | elect to have his or her office or work address in lieu of the | ||||||
12 | applicant's residence or mailing address. An applicant for an | ||||||
13 | Illinois Person with a Disability Identification Card must
also | ||||||
14 | submit with each original or renewal application, on forms | ||||||
15 | prescribed
by the Secretary, such documentation as the | ||||||
16 | Secretary may require,
establishing that the applicant is a | ||||||
17 | "person with a disability" as defined in
Section 4A of this | ||||||
18 | Act, and setting forth the applicant's type and class of
| ||||||
19 | disability as set forth in Section 4A of this Act.
For the | ||||||
20 | purposes of this subsection (a), "peace officer" means any | ||||||
21 | person who by virtue of his or her office or public employment | ||||||
22 | is vested by law with a duty to maintain public order or to | ||||||
23 | make arrests for a violation of any penal statute of this | ||||||
24 | State, whether that duty extends to all violations or is | ||||||
25 | limited to specific violations.

26 | (b) Beginning on or before July 1, 2015, for each original |
| |||||||
| |||||||
1 | or renewal identification card application under this Act, the | ||||||
2 | Secretary shall inquire as to whether the applicant is a | ||||||
3 | veteran for purposes of issuing an identification card with a | ||||||
4 | veteran designation under subsection (c-5) of Section 4 of this | ||||||
5 | Act. The acceptable forms of proof shall include, but are not | ||||||
6 | limited to, Department of Defense form DD-214. The Secretary | ||||||
7 | shall determine by rule what other forms of proof of a person's | ||||||
8 | status as a veteran are acceptable. | ||||||
9 | The Illinois Department of Veterans' Affairs shall confirm | ||||||
10 | the status of the applicant as an honorably discharged veteran | ||||||
11 | before the Secretary may issue the identification card. | ||||||
12 | For purposes of this subsection (b): | ||||||
13 | "Active duty" means active duty under an executive order of | ||||||
14 | the President of the United States, an Act of the Congress of | ||||||
15 | the United States, or an order of the Governor. | ||||||
16 | "Armed forces" means any of the Armed Forces of the United | ||||||
17 | States, including a member of any reserve component or National | ||||||
18 | Guard unit called to active duty. | ||||||
19 | "Veteran" means a person who has served on active duty in | ||||||
20 | the armed forces and was discharged or separated under | ||||||
21 | honorable conditions. | ||||||
