Amends the Chicago Municipal Article of the Illinois Pension Code. In a provision concerning the forfeiture of benefits due to a felony conviction relating to or arising out of or in connection with a participant's service as a municipal employee, provides that any refund required under the Chicago Municipal Article shall be calculated based on that person's contributions to the Fund, less the amount of any annuity benefit previously received by the person or his or her beneficiaries. Provides that the changes in the amendatory Act apply only to felony convictions or pleas of guilty to a felony entered on or after the effective date of the amendatory Act. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pension Code is amended by changing |
5 | | Section 8-251 as follows:
|
6 | | (40 ILCS 5/8-251) (from Ch. 108 1/2, par. 8-251)

7 | | Sec. 8-251. Felony conviction.
|
8 | | None of the benefits provided for in this Article shall be |
9 | | paid to any
person who is convicted of any felony relating to |
10 | | or arising out of or in
connection with his service as a |
11 | | municipal employee.
|
12 | | This Section section shall not operate to impair any |
13 | | contract or vested right
heretofore acquired under any law or |
14 | | laws continued in this Article, nor to
preclude the right to a |
15 | | refund. |
16 | | Any refund required under this Article shall be calculated |
17 | | based on that person's contributions to the Fund, less the |
18 | | amount of any annuity benefit previously received by the person |
19 | | or his or her beneficiaries. The changes made by this |
20 | | amendatory Act of the 99th General Assembly apply only to a |
