Amends the Local Records Act. Provides that an agency or commission may not destroy any public record, nonrecord material, or material not included within the definition of records as contained in this Act concerning complaints, investigations, and adjudications of police officer misconduct. Further provides that an agency shall permanently retain such records and materials. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Local Records Act is amended by adding |
5 | | Section 25 as follows: |
6 | | (50 ILCS 205/25 new) |
7 | | Sec. 25. Complaints of police officer misconduct. |
8 | | Notwithstanding any law to the contrary, an agency or |
9 | | commission may not destroy any public record, nonrecord |
10 | | material, or material not included within the definition of |
11 | | records as contained in this Act concerning complaints, |
12 | | investigations, and adjudications of police officer |
13 | | misconduct. An agency shall permanently retain such records and |
14 | | materials. For purposes of this Section, "police officer" shall |
15 | | include State Police officers and police officers of a unit of |
16 | | local government.

17 | | Section 99. Effective date. This Act takes effect upon |
18 | | becoming law.
