Amends the Local Records Act. Provides that a Local Records Commission may not destroy public records concerning complaints alleging misconduct by law enforcement officers without permission from the Attorney General.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Local Records Act is amended by adding |
5 | | Section 25 as follows: |
6 | | (50 ILCS 205/25 new) |
7 | | Sec. 25. Complaints of law enforcement misconduct. A public |
8 | | record concerning complaints alleging misconduct by law |
9 | | enforcement officers, including, but not limited to, audio |
10 | | records, videos, notes, statements, findings of facts, and |
11 | | decisions relating to alleged misconduct by law enforcement |
12 | | officers shall not be destroyed by the Local Records Commission |
13 | | unless the Commission has requested and received approval to |
14 | | destroy such public records from the Attorney General. For |
15 | | purposes of this section, "law enforcement officer" shall |
16 | | include State Police officers and police officers of a unit of |
17 | | local government.
