Creates the For-Profit Community Corrections Prohibition
Act. Provides that on or after the effective date of the Act, the State shall not
contract with a for-profit prison company for community correctional supervision of persons in
the custody of the Department of Corrections or the Department of Juvenile
Justice. Provides that nothing in the Act shall be construed to allow privatization prohibited by the Private Correctional Facility Moratorium Act. Defines "community correctional supervision" and "for-profit prison company".

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 1. Short title. This Act may be cited as the |
| 5 | | For-Profit Community Corrections Prohibition
Act.

| 6 | | Section 5. Purpose. The purpose of this Act is to provide |
| 7 | | effective community-based
supervision and rehabilitative |
| 8 | | services to persons under the supervision of the Parole |
| 9 | | Division of
the Department of Corrections or the Aftercare |
| 10 | | Division of the Department of
Juvenile Justice.

| 11 | | Section 10. Definitions. As used in this Act: |
| 12 | | "Community correctional supervision" includes surveillance |
| 13 | | of parolees and persons released on mandatory supervised |
| 14 | | release in the community and
rehabilitative re-entry services |
| 15 | | for persons under the supervision of the Parole Division of the
|
| 16 | | Department of Corrections or the Aftercare Division of the |
| 17 | | Department of
Juvenile Justice, including residential, |
| 18 | | employment, educational, substance and alcohol abuse,
and |
| 19 | | mental health programming. |
| 20 | | "For-profit prison company" means a for-profit corporation |
| 21 | | or business entity not organized or
operating as a |
| 22 | | not-for-profit entity that owns, manages, or operates |
