SYNOPSIS AS INTRODUCED:

New Act

Creates the Independent Commission on Law Enforcement Act. Provides that the purpose of the Act is to investigate and review incidents of law enforcement officer-involved shootings, use of deadly force by law enforcement, complaints of the use of excessive force, and complaints of wrongful death. Sets forth membership of the Commission. Requires the Commission to issue a report by July 1, 2016, and each July 1 thereafter, containing findings of best practices within the State and across the nation with respect to law enforcement policies on the citizen complaint process, the internal disciplinary system, community outreach and communication practices, use of force procedures, and investigations of officer complaints, and recommending statutory and programmatic changes.

A BILL FOR

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Independent Commission on Law Enforcement Act.

Section 5. Purpose.

(1) The purpose of this Act is to investigate and review incidents of law enforcement officer-involved shootings, use of deadly force by law enforcement, complaints of the use of excessive force, and complaints of wrongful death. The Commission shall review incidents that have been subject to and completed an investigative procedure, either by an internal investigation conducted by the law enforcement agency, or by an independent investigative agency appointed by the law enforcement agency or another entity otherwise appointed, mandated, or requested, and filed with the Commission.

(2) The Commission shall work in partnership with State and local law enforcement agencies, community leaders, and community organizations to examine and review the current structure and operation of law enforcement agencies within the State of Illinois regarding the citizen complaint process, the internal disciplinary system, community outreach and communication practices, use of force procedures, and investigations of officer complaints.

(3) The Commission shall compare current procedures implemented by State and local law enforcement agencies to best practices recognized across the State, nationwide, and the best and relevant procedures developed by the United States Department of Justice Community Oriented Policing Services.

(4) The Commission shall review data of citizen complaints, incidents of officer-involved deaths, officer-involved shootings, and excessive use of force by officer.

(5) The Commission shall make recommendations to the Governor and General Assembly for statutory and programmatic changes necessary to ensure trust and mutual respect between police and the communities they serve and maintaining public safety.

(6) The goal of this Act is to assist in the implementation of recommendations made by the Commission by working with law enforcement agencies.

Section 10. Independent Commission on Law Enforcement. The Independent Commission on Law Enforcement shall be composed of the following members, to be appointed within 60 days after the effective date of this Act:

(1) Two members appointed by the Speaker of the House of Representatives, one of whom shall serve as a co-chair.

(2) Two members appointed by the President of the Senate, one of whom shall serve as a co-chair.

(3) One member appointed by the Minority Leader of the House of Representatives.

(4) One member appointed by the Minority Leader of the Senate.

(5) Two members appointed by the Governor.

(6) One representative from:

(A) the American Civil Liberties Union of Illinois;

(B) the Illinois Coalition for Immigrant and Refugee Rights;

(C) the Urban League;

(D) the National Association of the Advancement of Colored People;

(E) the Rainbow PUSH Coalition; and

(F) the Illinois Latino Family Commission.

The Independent Commission on Law Enforcement may organize staff to provide assistance and necessary support services.

Section 15. Reports. The Commission shall submit an initial report to the Governor and the General Assembly by July 1, 2016 on its finding of best practices within the State and across the nation with respect to law enforcement policies on the citizen complaint process, the internal disciplinary system, community outreach and communication practices, use of force procedures, and investigations of officer complaints, and recommend statutory and programmatic changes. By July 1 of each year thereafter, the Commission shall submit a report to the Governor and General Assembly that catalogs the changes and developments in law enforcement policies, and recommends and suggests statutory and programmatic changes.

Copies of each report shall be submitted to the Director of the Illinois State Police, the President of the Illinois Sheriffs' Association, and the Director of the Illinois Law Enforcement Training Standards Board.
