1 | AN ACT concerning State government.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
5 | Independent Commission on Law Enforcement Act. | |||||||||||||||||||
6 | Section 5. Purpose. | |||||||||||||||||||
7 | (1) The purpose of this Act is to investigate and | |||||||||||||||||||
8 | review incidents of law enforcement officer-involved | |||||||||||||||||||
9 | shootings, use of deadly force by law enforcement, | |||||||||||||||||||
10 | complaints of the use of excessive force, and complaints of | |||||||||||||||||||
11 | wrongful death. The Commission shall review incidents that | |||||||||||||||||||
12 | have been subject to and completed an investigative | |||||||||||||||||||
13 | procedure, either by an internal investigation conducted | |||||||||||||||||||
14 | by the law enforcement agency, or by an independent | |||||||||||||||||||
15 | investigative agency appointed by the law enforcement | |||||||||||||||||||
16 | agency or another entity otherwise appointed, mandated, or | |||||||||||||||||||
17 | requested, and filed with the Commission. | |||||||||||||||||||
18 | (2) The Commission shall work in partnership with State | |||||||||||||||||||
19 | and local law enforcement agencies, community leaders, and | |||||||||||||||||||
20 | community organizations to examine and review the current | |||||||||||||||||||
21 | structure and operation of law enforcement agencies within | |||||||||||||||||||
22 | the State of Illinois regarding the citizen complaint | |||||||||||||||||||
23 | process, the internal disciplinary system, community |

| |||||||
1 | outreach and communication practices, use of force | ||||||
2 | procedures, and investigations of officer complaints. | ||||||
3 | (3) The Commission shall compare current procedures | ||||||
4 | implemented by State and local law enforcement agencies to | ||||||
5 | best practices recognized across the State, nationwide, | ||||||
6 | and the best and relevant procedures developed by the | ||||||
7 | United States Department of Justice Community Oriented | ||||||
8 | Policing Services. | ||||||
9 | (4) The Commission shall review data of citizen | ||||||
10 | complaints, incidents of officer-involved deaths, | ||||||
11 | officer-involved shootings, and excessive use of force by | ||||||
12 | officer. | ||||||
13 | (5) The Commission shall make recommendations to the | ||||||
14 | Governor and General Assembly for statutory and | ||||||
15 | programmatic changes necessary to ensure trust and mutual | ||||||
16 | respect between police and the communities they serve and | ||||||
17 | maintaining public safety. | ||||||
18 | (6) The goal of this Act is to assist in the | ||||||
19 | implementation of recommendations made by the Commission | ||||||
20 | by working with law enforcement agencies.

21 | Section 10. Independent Commission on Law Enforcement. The | ||||||
22 | Independent Commission on Law Enforcement shall be composed of | ||||||
23 | the following members, to be appointed within 60 days after the | ||||||
24 | effective date of this Act: | ||||||
25 | (1) Two members appointed by the Speaker of the House |

1 | of Representatives, one of whom shall serve as a co-chair. | ||||||
2 | (2) Two members appointed by the President of the | ||||||
3 | Senate, one of whom shall serve as a co-chair. | ||||||
4 | (3) One member appointed by the Minority Leader of the | ||||||
5 | House of Representatives. | ||||||
6 | (4) One member appointed by the Minority Leader of the | ||||||
7 | Senate. | ||||||
8 | (5) Two members appointed by the Governor. | ||||||
9 | (6) One representative from: | ||||||
10 | (A) the American Civil Liberties Union of | ||||||
11 | Illinois; | ||||||
12 | (B) the Illinois Coalition for Immigrant and | ||||||
13 | Refugee Rights; | ||||||
14 | (C) the Urban League; | ||||||
15 | (D) the National Association of the Advancement of | ||||||
16 | Colored People; | ||||||
17 | (E) the Rainbow PUSH Coalition; and | ||||||
18 | (F) the Illinois Latino Family Commission. | ||||||
19 | The Independent Commission on Law Enforcement may organize | ||||||
20 | staff to provide assistance and necessary support services.

21 | Section 15. Reports. The Commission shall submit an initial | ||||||
22 | report to the Governor and the General Assembly by July 1, 2016 | ||||||
23 | on its finding of best practices within the State and across | ||||||
24 | the nation with respect to law enforcement policies on the | ||||||
25 | citizen complaint process, the internal disciplinary system, |

1 | community outreach and communication practices, use of force | ||||||
2 | procedures, and investigations of officer complaints, and | ||||||
3 | recommend statutory and programmatic changes. By July 1 of each | ||||||
4 | year thereafter, the Commission shall submit a report to the | ||||||
5 | Governor and General Assembly that catalogs the changes and | ||||||
6 | developments in law enforcement policies, and recommends and | ||||||
7 | suggests statutory and programmatic changes. | ||||||
8 | Copies of each report shall be submitted to the Director of | ||||||
9 | the Illinois State Police, the President of the Illinois | ||||||
10 | Sheriffs' Association, and the Director of the Illinois Law | ||||||
11 | Enforcement Training Standards Board.
