2 | | AMENDMENT NO. ______. Amend House Bill 3758 on page one, |
3 | | line 5 by deleting "2,"; and |
4 | | on page one, line 5, after "12," by inserting "14,"; and
|
5 | | by deleting line 7, page one through line 9, page 3; and
|
6 | | by replacing line 16, page 7 through line 19, page 8 with the |
7 | | following:

8 | | "(70 ILCS 1810/12) (from Ch. 19, par. 163)
|
9 | | Sec. 12.
(a) The governing and administrative body of the |
10 | | District shall
be a board consisting of 5 9 members, to be |
11 | | known as the Illinois
International
Port District Board , who |
12 | | shall be appointed for a term of 3 years by the Mayor with the |
13 | | advice and consent of the city council of the city of Chicago . |
14 | | Members of the Board shall be residents of a
county whose |

|
1 | | territory, in whole or in part, is embraced by the District
and |
2 | | persons of recognized business ability. The members of the |
3 | | Board
shall receive no compensation for their services ,
set by |
4 | | the Board at an amount not to exceed $20,000.00 annually, |
5 | | except
the Chairman may receive an additional $5,000.00 |
6 | | annually, if approved by
the Board. All such compensation shall |
7 | | be paid directly from the Port
District's operating funds. The |
8 | | members shall receive no other compensation
whatever, whether |
9 | | in form of salary, per diem allowance or otherwise, for or in
|
10 | | connection with his service as a member.
The preceding sentence |
11 | | shall not prevent any member from receiving any
non-salary |
12 | | benefit of the type received by employees of the District .
Each |
13 | | member may shall be reimbursed
for actual expenses incurred by |
14 | | them in the performance of their duties.
Any person who is |
15 | | appointed to the office of secretary or treasurer
of the Board |
16 | | may receive compensation for services as such officer,
as |
17 | | determined by the Board, provided such person is not a member |
18 | | of the
Board. No member of the Board or employee of the |
19 | | District
shall have any private
financial interest, profit or |
20 | | benefit in any contract, work or business
of the District nor |
21 | | in the sale or lease of any property to or from the
District.

22 | | (b) The terms of all members of the Illinois International |
23 | | Port District Board serving on the effective date of this |
24 | | amendatory Act of the 99th General Assembly end on the 31st day |
25 | | after the effective date of this amendatory Act of the 99th |
26 | | General Assembly. Thereafter, the seat of each member shall be |

1 | | vacant and subject to reappointment as provided in subsection |
2 | | (a) of this Section. |

5 | | Sec. 14. Members of the Board shall hold office until their |
6 | | respective
successors have been appointed and qualified. Any |
7 | | member may resign from
his or her office, to take effect when |
8 | | his or her successor has been appointed and has
qualified. The |
9 | | Governor and the Mayor , respectively, may remove any member
of |
10 | | the Board appointed by him or her in case of incompetency, |
11 | | neglect of duty, or
malfeasance in office. They shall give him |
12 | | or her a copy of the charges against
him or her and an |
13 | | opportunity to be publicly heard in person or by counsel in his |
14 | | or her
own defense upon not less than ten days' notice. In case |
15 | | of failure to
qualify within the time required, or of |
16 | | abandonment of his or her office, or in
case of death, |
17 | | conviction of a crime or removal from office, his office
shall |
18 | | become vacant. Each vacancy shall be filled for the unexpired |
19 | | term by
appointment in like manner, and with like regard as to |
20 | | the place of
residence of the appointee, as in case of |
21 | | expiration of the term of a
member of the Board.
