1 | | AN ACT concerning finance.
|
2 | | WHEREAS, African-Americans represent 14.7% of the total |
3 | | population of Illinois
residents; the unemployment rate for |
4 | | African-Americans in Illinois is projected to be 13.5%,
nearly |
5 | | double the rate for the total State population; and
|
6 | | WHEREAS, African-Americans represent 9.5% of the ownership |
7 | | of total Illinois
businesses; the total value of State |
8 | | contracts awarded to African-American-owned businesses in 2013 |
9 | | was less
than 1% of total Central Management Services spending; |
10 | | and
|
11 | | WHEREAS, Unemployment leads to a decline in communities, |
12 | | resulting in
foreclosures, abandoned buildings, violence, |
13 | | depression, and poverty; therefore
|
14 | | Be it enacted by the People of the State of Illinois,
|
15 | | represented in the General Assembly:
|
16 | | Section 1. Short title. This Act may be cited as the Fair
|
17 | | Practices in Contracting Task Force Act. |
18 | | Section 5. Purpose and members.
|
19 | | (a) There is created the Fair Practices in Contracting Task
|
20 | | Force to: |

1 | | (1) thoroughly survey African-American-owned business
|
2 | | participation in State procurement; |
3 | | (2) study African-American-owned subcontractors' |
4 | | ability to be paid in a timely manner and the communication |
5 | | processes between subcontractors and prime contractors and |
6 | | the State; |
7 | | (3) research solutions and methods to address the
|
8 | | disparity in procurement awards; and |
9 | | (4) produce a final report summarizing the Task Force's
|
10 | | findings and detailing recommended statutory or
|
11 | | constitutional strategies to recognize best practices. |
12 | | (b) The Task Force shall consist of the following members: |
13 | | (1) One member of the House of Representatives, |
14 | | appointed by the Speaker of the
House of Representatives; |
15 | | (2) One member of the House of Representatives, |
16 | | appointed by the Minority Leader of the House of |
17 | | Representatives; |
18 | | (3) One member of the Senate, appointed by the |
19 | | President of the Senate; |
20 | | (4) One member of the Senate, appointed by the Minority |
21 | | Leader of the Senate; |
22 | | (5) Four members appointed by the Governor, 3 of whom |
23 | | must be from the Department of Central Management Services, |
24 | | the Department of Transportation, or the Department of |
25 | | Health and Family Services, and one of whom must be a |
26 | | member of the Illinois African-American Family Commission; |

2 | | (6) Four members of the public, representing |
3 | | minority-owned businesses, appointed by the Governor. |
4 | | (c) Members shall serve without compensation. |
5 | | Section 10. Meetings. |
6 | | (a) The Task Force shall hold its first meeting by March 1,
|
7 | | 2016. |
8 | | (b) The Department of Central Management Services shall
|
9 | | assist the Task Force and provide administrative support, but
|
10 | | shall have no hand in guiding its direction or ascertaining its
|
11 | | results. |
12 | | (c) The Task Force shall meet quarterly and report its
|
13 | | findings to the General Assembly and the appropriate
|
14 | | committees. |
15 | | (d) The Task Force shall submit its final report to the
|
16 | | General Assembly and the Governor no later than December 31,
|
17 | | 2017. |
18 | | Section 15. Repeal date. This Act is repealed on January |
19 | | 2,
2019.
