Amends the Food Handling Regulation Enforcement Act. Provides that neither the Department of Public Health nor the health department of a unit of local government may regulate the selling of food that is brought to a bake sale sponsored by a group of individuals or a religious, charitable, or nonprofit organization by individuals attending the bake sale for consumption at the bake sale. Prohibits a business establishment dealing in the sale of food items from sponsoring a bake sale. Provides that no fee may be charged for admission to a bake sale exempt from regulation under the amendatory Act. Defines "bake sale".

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Food Handling Regulation Enforcement Act is |
5 | | amended by adding Section 3.7 as follows: |
6 | | (410 ILCS 625/3.7 new) |
7 | | Sec. 3.7. Bake sales. |
8 | | (a) As used in this Section, "bake sale" means an event |
9 | | that meets all of the following conditions: |
10 | | (1) It is a fundraising event where volunteers sell |
11 | | food items on behalf of a group of individuals or a |
12 | | religious, charitable, or nonprofit organization. |
13 | | (2) There is no compensation provided to people for |
14 | | bringing food to or selling food at the event. |
15 | | (3) The event is not conducted for commercial purposes. |
16 | | (4) It is generally understood by the participants at |
17 | | the event that neither the food nor the facilities have |
18 | | been inspected by the State or a local certified public |
19 | | health department. |
20 | | (b) Notwithstanding any other provision of law, neither the |
21 | | Department of Public Health nor the health department of a unit |
22 | | of local government may regulate the selling of food that is |
23 | | brought to a bake sale sponsored by a group of individuals or a |
