Amends the Illinois Pesticide Act. Provides that no person, other than a pesticide applicator licensed under this Act, may apply pesticide within any building or on the grounds of any school, other than a regional agricultural science and technology education center. Provides that no person shall apply a lawn care pesticide on the grounds of any public or private preschool or public or private school with students in grade 12 or lower, except that an emergency application of a lawn care pesticide may be made to eliminate a threat to human health.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Pesticide Act is amended by adding |
5 | | Section 14.5 as follows: |
6 | | (415 ILCS 60/14.5 new) |
7 | | Sec. 14.5. Use of pesticides on school grounds. |
8 | | (a) No person, other than a pesticide applicator licensed |
9 | | under this Act, may apply pesticide within any building or on |
10 | | the grounds of any school, other than a regional agricultural |
11 | | science and technology education center. This Section shall not |
12 | | apply in the case of an emergency application of pesticide to |
13 | | eliminate an immediate threat to human health where it is |
14 | | impractical to obtain the services of any such applicator |
15 | | provided such emergency application does not involve a |
16 | | restricted use pesticide. |
17 | | (b) No person shall apply a lawn care pesticide on the |
18 | | grounds of any public or private preschool or public or private |
19 | | school with students in grade 12 or lower, except that an |
20 | | emergency application of a lawn care pesticide may be made to |
21 | | eliminate a threat to human health, as determined by local |
22 | | health departments, the Director of Public Health, the Director |
23 | | of the Environmental Protection Agency or, in the case of a |
